Teachers Constituency38. The educational institution within the States of Andhra Pradesh, Bihar, Karnataka,Maharashtra and Uttar Pradesh, which are having State Legislative Councils, which aredeemed to be not lower in standard than that of a secondary school are notified by the StateGovernment concerned. Section 20(4) of the Representation of the People Act, 1950 doesnot apply to Teachers’ Constituency. There<strong>for</strong>e, a declared office hold who fulfils thequalifications <strong>for</strong> registration in the Teachers’ Constituency, is not entitled to beregistered in his home Constituency. He should be registered only where heordinarily reside. In the case of a person who is resident in a particular place at the timeof filling the application and who later on shifts his residence to some other place outsidethe Constituency, he loses his residential qualification and his application has to be rejectedby the <strong>Electoral</strong> <strong>Registration</strong> Officer. But if a person moves to another place within theConstituency and the new place of residence is also known to the <strong>Electoral</strong> <strong>Registration</strong>Officer, there is no objection to the <strong>Electoral</strong> <strong>Registration</strong> Officer, including the name ofthe applicant at that new address which is different from the address mentioned in the claim<strong>for</strong>m provided the new address is within the Constituency and is known to the <strong>Electoral</strong><strong>Registration</strong> Officer.39. Every teacher who has been engaged in teaching <strong>for</strong> the qualifying period in aneducational institution of the prescribed standard will be entitled to be registered as anelector irrespective of whether he is teaching in the primary section, middle section or anyother section of the institution.40. Teachers of tutorial colleges are not eligible to be registered as voters. Retiredteachers, who satisfy the qualifications <strong>for</strong> inclusion of names as electors, i.e., those whohad been engaged in teaching <strong>for</strong> a total period of at least three years within the six yearsimmediately be<strong>for</strong>e the qualifying date in educational institution of the prescribed standardare eligible <strong>for</strong> inclusion in the <strong>Electoral</strong> Roll.41. The disqualification <strong>for</strong> registration under section 16 of the Representation of thePeople Act, 1950 will apply in respect of enrolment in Council Constituencies also. Aperson cannot be registered as voter more than once in any Constituency or in more thanone Constituency of the same category. But a person can, if duly qualified be registered asa voter in Constituencies of different categories, namely, Graduates’ Teachers’ and LocalAuthorities, as these are treated as falling under different category. For example a graduateteacher with the requisite qualification will be entitled to be registered both in theGraduates’ Constituency and also in the Teachers’ Constituency. The <strong>Electoral</strong> Roll shouldbe divided into convenient parts, which should be numbered consecutively. The number ofnames included limit in any part should not be very large, say, not exceeding 1000 but thereis no minimum limit in regard to the number of entries in a part. The various parts shouldbe numbered consecutively with reference to their geographical position. In the case ofConstituencies spreading over more than one district, numbering should be with referenceto the portions included in each district. Within each district numbering should begin fromthe north-western corner and after proceeding in a zigzag manner should end in the southeasterncorner. A register of the parts shall be prepared and maintained in the <strong>for</strong>m givenbelow:104
