It should also be noted that when a continuous updation supplementary actuallygets integrated, the continuous updation supplements upto that point get cleaned out, anda fresh continuous updation supplement numbering gets started on the date after that.General Guidelines <strong>for</strong> Deletion, Inclusions, Transposition & Corrections23. During continuous updation, ERO has got power under Section 22 of theRepresentation of the People Act, 1950 to correct, transpose or delete any entry in thefinally published roll if, either on an application made to him or on his own motion (suomotu),he is satisfied after such enquiry as he thinks fit that the entry is erroneous ordefective in any particular, or should be transposed to another place in the roll on theground that the person concerned has changed his place of ordinary residence within theConstituency or should be deleted on the ground that the person concerned is dead or hasceased to be ordinarily resident in the Constituency or is otherwise not entitled to beregistered in that roll. This power is subject to any general or special directions issued bythe <strong>Commission</strong> in this behalf. But be<strong>for</strong>e taking any action <strong>for</strong> amendment ortransposition or deletion of an entry on the ground that the person concerned has ceasedto be ordinarily resident in the Constituency or that he is otherwise not entitled to beregistered in the <strong>Electoral</strong> Roll of that Constituency, the ERO shall give the personconcerned a reasonable opportunity of being heard in respect of the action proposed tobe taken in relation to him.24. Under Section 23 of RPA 1950, any person who finds that his/her name is notincluded in the finally published roll of a Constituency, may apply to the <strong>Electoral</strong><strong>Registration</strong> Officer <strong>for</strong> the inclusion of his name in that roll. Normally, such cases wouldbe few as the annual revision w.r.t. the first January of the year as the qualifying datewould have been conducted. Generally, the applications in Form-6 received duringcontinuous updation would be from persons who have shifted in from some otherconstituency. There<strong>for</strong>e Care should also be taken to ensure that in case of applicantsdesirous of getting enrolled on becoming 18 years of age, actually had become of age onthe qualifying date i.e. 1 st January of the year in question and not on any other date in thatyear.25. Persons shifting their place of residence within the same constituency shouldbe guided to file application <strong>for</strong> transposition of entry in Form 8A and not in Form6 as is the normal practice. The transposition of a name can be made under Section 22from one part of the roll to another part of the same roll or within the same part from oneplace to another place. But this cannot be invoked <strong>for</strong> transposition of a name from oneAssembly Constituency to another. For this purpose, a person desiring transfer of hisname should apply in Form 6 under Section 23 to the ERO of the latter Constituency.26. Inclusion of any of these names through Form 6 would require correspondingdeletion in some other part of electoral roll of the same constituency. There<strong>for</strong>e, whileaccepting any Form 6 during the period of continuous updation it should be ensured thatthe declaration about the period of stay at the new address and also the address ofprevious residence is completely filled up.
