5. The members to represent Local Authorities, graduates and teachers shall be chosenfrom territorial Constituencies. The elections to the State Legislative Councils fromCouncil Constituencies and by M.L.As. shall be held in accordance with the system ofproportional representation by means of the single transferable vote.6. Legislative Council of a State shall not be subject to dissolution, but as nearly aspossible one-third of the members thereof shall retire as soon as may be on the expiration ofevery second year in accordance with the provisions made in that behalf by Parliament bylaw.7. The allocation of seats in the Legislative Council of the States having such Councilsis given in Annexure-13.1.8. The number of seats to be filled by persons elected by M.L.As. and fromGraduates’, Teachers’ and Local Authorities’ Constituencies and by nomination is alsoindicated in the aforesaid Annexure-13.1.9. The President has already determined the territorial constituencies into which eachState having a Legislative Council shall be divided for the purpose of elections to thatCouncil by the Local Authorities’, Graduates and Teachers, the extent of each suchConstituency and the number of seats allocated to each Constituency.10. The President may, from time to time, after consulting the Election Commission, byan order alter or amend any order made by him for the delimitation of CouncilConstituencies. Every order made by the President regarding delimitation of CouncilConstituencies or any amendment thereto shall be laid before Parliament, as soon as may beafter it is made, and shall be subject to such modification as Parliament may made on amotion within twenty days from the date on which the order is so laid.Electoral Registration Officers for Council Constituencies11. For each of the Graduates’, Teachers’, and Local Authorities’ Constituencies of theLegislative Council, an Electoral Registration Officer is appointed. The DivisionalCommissioners / Deputy Commissioners are appointed as such Electoral RegistrationOfficers. Normally, all Tahsildars and independent Deputy Tahsildars in the districtsincluded in a Graduates’, or Teachers’ Constituency are appointed as Assistant ElectoralRegistration Officers. Normally, Assistant Electoral Registration Officers are notappointed in any of the Local Authorities’ Constituencies.12. For the purpose of elections to the Legislative Council of a State in any LocalAuthorities’ Constituency, the electorate shall consist of members of the local authoritiesexercising jurisdiction in any place or area within the limits of that Constituency as arespecified in relation to that State in Annexure-13.2.13. Every member of each such local authority within a Local Authorities’Constituency shall be entitled to be registered in the Electoral Roll for that Constituency.98
Electoral Rolls for Local Authorities’ Constituencies14. Electoral Registration Officer for every Local Authorities’ Constituency shallmaintain in his office in the prescribed manner and form the Electoral Roll for thatConstituency corrected up-to-date. The Commission, vide its letter no. 322/LC/INST/2010-CC&BE dated 24 th February, 2010 has issued instructions for preparation of Electoral Rollsfor Local Authorities’ Constituencies as under :-i) Under Rule 30 (1) of the Registration of Electors Ru les, 1960, the Commission hasdirected that the electoral rolls of the Local Authorities’ Constituencies is required to bemaintained by the Electoral Registration Officer of the Local Authorities Constituencyconcerned under Section 27 (2) (c) of the Repr esentation of the People Act 1950. Itshall be prepared and maintained in the following format :-Name of the Local Authorities Constituency:S.No.Name oftheelectorSex Age Father’s/Husband’s/Mother’s or otherrelation’s nameEducationalstatusName of theLocal Authorityof which he/sheis a Memberii) For this purpose the Chief Executive Officer of the Local Authority while furnishingthe list of members of the Local Authority under section 27(2)(d) of the Representationof People Act, 1950 indicate the educational status of the each member; that is to saywhether the member is able to read names on any papers and write figures 1, 2, 3, etc.iii) The electoral roll shall be prepared in the official language of the State and in English.The Commission has further directed that the electoral rolls shall be published by theElectoral Registration Officer in his office and also in the offices of the LocalAuthorities comprised in the Local Authorities Constituency, immediately invitingclaims and objections by giving a minimum of seven days for the purpose. Any claims(in Form 17) and objections received within the time fixed shall be disposed of by theERO within a period of three days and the roll shall be again published afterincorporating the claims and objections accepted within three days thereafter and inany case before the last date for filing of nominations. The provisions of Section 23(3)of RP Act 1950 will also apply in this case, i.e. no addition/deletion/amendment shallbe made in the electoral roll after 3.00 P.M. on the last date for filing of nomination.15 The Commission further directs for the electoral roll of the Local Authorities’Constituencies that :-i) It shall be prepared in as many separate parts as there are Tahsils or Talukas in theConstituency.ii) Each Constituent Local Authority within the Constituency shall be allocated separatepage or pages in the part and the names of the members of that Local Authority shall beentered in that page or those pages. Every page shall be in the form given above.99
