5. The members to represent Local Authorities, graduates and teachers shall be chosenfrom territorial Constituencies. The elections to the State Legislative Councils fromCouncil Constituencies and by M.L.As. shall be held in accordance with the system ofproportional representation by means of the single transferable vote.6. Legislative Council of a State shall not be subject to dissolution, but as nearly aspossible one-third of the members thereof shall retire as soon as may be on the expiration ofevery second year in accordance with the provisions made in that behalf by Parliament bylaw.7. The allocation of seats in the Legislative Council of the States having such Councilsis given in Annexure-13.1.8. The number of seats to be filled by persons elected by M.L.As. and fromGraduates’, Teachers’ and Local Authorities’ Constituencies and by nomination is alsoindicated in the a<strong>for</strong>esaid Annexure-13.1.9. The President has already determined the territorial constituencies into which eachState having a Legislative Council shall be divided <strong>for</strong> the purpose of elections to thatCouncil by the Local Authorities’, Graduates and Teachers, the extent of each suchConstituency and the number of seats allocated to each Constituency.10. The President may, from time to time, after consulting the <strong>Election</strong> <strong>Commission</strong>, byan order alter or amend any order made by him <strong>for</strong> the delimitation of CouncilConstituencies. Every order made by the President regarding delimitation of CouncilConstituencies or any amendment thereto shall be laid be<strong>for</strong>e Parliament, as soon as may beafter it is made, and shall be subject to such modification as Parliament may made on amotion within twenty days from the date on which the order is so laid.<strong>Electoral</strong> <strong>Registration</strong> <strong>Officers</strong> <strong>for</strong> Council Constituencies11. For each of the Graduates’, Teachers’, and Local Authorities’ Constituencies of theLegislative Council, an <strong>Electoral</strong> <strong>Registration</strong> Officer is appointed. The Divisional<strong>Commission</strong>ers / Deputy <strong>Commission</strong>ers are appointed as such <strong>Electoral</strong> <strong>Registration</strong><strong>Officers</strong>. Normally, all Tahsildars and independent Deputy Tahsildars in the districtsincluded in a Graduates’, or Teachers’ Constituency are appointed as Assistant <strong>Electoral</strong><strong>Registration</strong> <strong>Officers</strong>. Normally, Assistant <strong>Electoral</strong> <strong>Registration</strong> <strong>Officers</strong> are notappointed in any of the Local Authorities’ Constituencies.12. For the purpose of elections to the Legislative Council of a State in any LocalAuthorities’ Constituency, the electorate shall consist of members of the local authoritiesexercising jurisdiction in any place or area within the limits of that Constituency as arespecified in relation to that State in Annexure-13.2.13. Every member of each such local authority within a Local Authorities’Constituency shall be entitled to be registered in the <strong>Electoral</strong> Roll <strong>for</strong> that Constituency.98
