Form and Language of Electoral Rolls28. Under rule 30 of the Registration of Electors Rules, 1960 the roll for every LocalAuthorities’ Constituency shall be prepared and maintained in such form, manner andlanguage or languages as the Election Commission may direct.29. The rolls shall be prepared in the States of Bihar and Uttar Pradesh in Hindi and inthe State of Andhra Pradesh in Telugu and English, Karnataka in Kannada and English andin the State of Maharashtra in Marathi and English.30. Under Rule 31 of the Registration of Electors Rules, 1960, the roll for everyGraduates’ or Teachers’ Constituency shall be prepared in such form, manner and languageor languages as the Election Commission may direct. 32. The rolls shall be divided into convenient parts which shall be numberedconsecutively.33. The rolls contemplate a de novo preparation of Electoral Roll of a Graduates’ orTeachers’ Constituency before every biennial election. For the purpose of preparing theroll for a Graduates’ or a Teachers’ Constituency, Electoral Registration Officer shall, on orbefore the 1 st October, issue a public notice calling upon every person entitled to beregistered in that roll to send to, or deliver to, his office before the 7 th day of Novembernext following (i.e. by the 6 th November) application in Form 18 for (Graduates’Constituencies) or Form 19 (for Teacher s’ Constituencies), as the case may be, for theinclusion of his name.34. The said notice shall be published in two newspapers having circulation in theConstituency and republished in them once on or about 15 th October and again on or about25 th October.35. In the case of revision of the Electoral Roll before any bye-election to fill a casualvacancy in a seat allotted to a Graduates’ or a Teachers’ Constituency contemplated underSection 21(2) (a) (ii) mentioned in paragraph 27 above and references to 15 th October and25 th October mentioned in paragraph 28 above will be construed as references to 15 thOctober and 25 th October mentioned in paragraph 28 above will be construed as referencesto such dates as may be specified by the Election Commission in relation to each suchrevision.36. The provision of rules 10 to 27 except clause (c) of sub –rule (1) and clause (c) ofsub-rule (2) of rule 13 of the Registration of Electors Rules, 1960, shall apply in relation toGraduates’ and Teachers’ Constituencies as they apply in relation to AssemblyConstituencies. The only difference is that an application for the inclusion of a name shallbe made in Form 18 or Form 19, as may be appropriate.Graduates’ Constituency37. In the case of Graduates’ Constituency, not only graduates, but persons who are inpossession of any equivalent qualification are also entitled to be registered in the roll. Thestatement showing qualifications deemed to be equivalent to that of graduate is availablewith the State Government. The three year period for which a person should be a graduatebefore registration will count from the date on which the result of the qualifying degreeexamination was declared and published by the university or an authority concerned andnot from the date of convocation. It is not necessary that a person should be a registeredgraduate. In case a declared office holder who fulfils the qualification wants to get hisname enrolled in the Graduates’ Constituency he can do so; but only in the placewhere he ordinarily resides and not his own Constituency where he will be deemed tobe ordinarily resident as section 20(4) of the Representation of the People Act, 1950 doesnot apply to Graduate Constituency.103
