the capacity market auctions, the plants that are ready to commit reliable power at the lowest cost<br />

are chosen first. Once the projected demand for the future has been met, the plants that are<br />

offering to supply power at higher costs are said to have not cleared the market. The structure of<br />

capacity markets has often been manipulated by utilities to ensure greater profits. 429<br />

The response of utilities with nuclear plants to their inability to clear auctions has been to blame<br />

the structure of the markets rather than their own high costs. Joseph Dominguez, Exelon’s senior<br />

vice president for governmental and regulatory affairs and public policy, told the NEI that “the<br />

market does not sufficiently recognize the significant value that nuclear plants provide in terms<br />

of reliability and environmental benefits”. 430 Subsequently, Exelon, along with PSE&G, another<br />

utility that operates nuclear plants, submitted comments to PJM arguing that the capacity market<br />

should be “redesigned to value high-availability capacity” and the failure of “over 4 GW of highly<br />

reliable nuclear capacity” to clear the markets only means that the “market signal (…) is clearly<br />

wrong and further demonstrates a need for changes to PJM’s market design”. 431 Likewise, Exelon<br />

also put forward proposals to MISO to allow it to get higher prices for their nuclear plants. 432<br />

In July 2015, the Federal Energy Regulatory Commission (FERC) approved PJM’s restructuring<br />

proposals that would allow it to increase payments to utilities that can more reliably deliver<br />

power. The nuclear industry commended these changes, and NEI’s Vice President for Policy<br />

Development and Planning Richard Myers announced: “This proposal should improve the<br />

economic advantage for the 33 nuclear power plants in PJM’s operating area”. 433 The result of the<br />

changes was that there were “higher auction clearing prices” and the capacity cost was “almost<br />

40 percent higher” than in 2014. 434 Despite the higher prices, in August 2015, Exelon announced<br />

that three of its nuclear plants, “Oyster Creek, Quad Cities and Three Mile Island (…) did not clear<br />

in the PJM capacity auction for the 2018-19 planning year”. 435 The company also announced that<br />

“a portion of the Byron nuclear plant’s capacity did not clear the auction”. 436<br />
