The Agent has submitted a comparison of overshadowing as approved (2008 approval) and as built which shows that overshadowing occurs more during the period with the shortest daylight hours of the year i.e. December. Overall, the dwelling as built raises little additional impact over that previously approved in 2008. Having said this, given the proximity of the property to 3 Reeves Lane, a condition should be imposed restricting the insertion of windows, extensions/alterations and outbuildings etc. Other Issues Amended plans have been requested following a site meeting with the Agent as the elevations on plan were not the same as the dwelling as built. These changes are very minor in nature but include decorative detailing, the window positions have changed slightly (but not materially) on the north elevation at ground and first floor level, the porch is slightly higher due to the addition of decorative detailing above the door and similarly in the garage a window size has been enlarged at ground floor on the east elevation. Crime and Disorder This application does not raise issues regarding crime and disorder. CONCLUSION The key issue in this case is the impact of the change in location of the dwelling 0.5m closer to the north boundary wall than previously approved under the 2008 permission. The 2003 permission approved a dwelling with a window in the gable end approx 2m from the boundary with 3 Reeves Lane and this dwelling was capable of being implemented prior to the submission of the 2008 application. In 2008, the case officer, with the 2003 permission in mind, tried to improve the environment for the occupiers of 3 Reeves Lane by handing the extension so that it sat to the south of an area of blank wall which would alleviate some overlooking and overshadowing of the garden area to 3 Reeves Lane. The dwelling that has been built albeit 0.5m further to the north, is essentially the same dwelling (bar minor detailing) as approved in 2008. The difference in overlooking, overshadowing and whether the dwelling has an overbearing impact on 3 Reeves Lane is marginal and has little additional impact than that previously approved in 2008. On this basis, the retention of the dwelling is acceptable subject to a condition restricting permitted development rights regarding the insertion of windows and extensions and alterations to the property and outbuildings. 11/01704/F Development Control Board 25 July 2011 118
RECOMMENDATION: APPROVE subject to the imposition of the following condition(s): 1 Condition Notwithstanding the provisions of Classes A, B, C, E of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no extensions, improvements or other alterations to the house including the insertion of windows; additions/alterations to the roof; or buildings, enclosures, swimming or other pool or containers shall be allowed without the granting of specific planning permission. 1 Reason In order that the Local Planning Authority may retain control of development which might be detrimental to the amenities of the locality if otherwise allowed by the mentioned Order.
