BOC Immingham Dissolved Acetylene Project Environmental Statement: Vol. 2 Main Text Consultation Body NE (William Maclennan) Date of Response 14 th April 2011 Consultees Responses Comments ES Response The most significant aspect for the HA is the implication of moving large amounts of hazardous materials (raw materials and product) via the strategic road network, in particular acetylene cylinders. The HA would wish to see discuss: � details for the strategy and arrangements for addressing emergencies close to on the A180 (including details and response times for the deployment of chemical response and clean-up teams); � proposals for closure diversion should the A1173 A180 route be compromised by an incident on the road network; and � details of exclusion zones diversionary routes that could be needed as a result of a major incident on the site. The location of this proposal in relation to the Humber Estuary means that the provisions of the Wildlife and Countryside Act 1981 (as amended) and the Habitats Regulations 2010 will apply. Any assessment will need to consider potential impacts of the development both within and adjacent to the designated sites on all of the features of the SSSI, SPA, Ramsar and SAC. Natural England therefore advises that the Environmental Report should include sufficient information to allow the “competent authority” (in this case the North East Lincolnshire Council) to make the judgements required of them under the Habitats Regulations. In its response, the HA recognised that some of these issues, and its information requirements, were either inappropriate to include in the ES and or were of a sensitive nature. The HA offered to meet with BOC to discuss these issues on a confidential basis prior to completion of the ES. A meeting between BOC and the HA was held in Leeds on 15 th July 2011. Three actions arose as a result of the meeting: � the ES is to make reference to an incident offsite invoking use of the HA tactical diversion route (see Chapter 12). � BOC to ensure that the HFRS have the HA representative’s contact details so that HFRS will always have access to the latest copy of the HA tactical diversion route. � BOC is to keep the HA representative updated on the progress of the Dissolved Acetylene Project. The EIA has considered potential impacts of the development both within and adjacent to the designated sites on all of the features of the SSSI, SPA, Ramsar and SAC (see Chapter 10 (Ecology)). Information to Inform a HRA: Screening Report 6 was submitted to NE and NELC on 21 st June. BOC Immingham Dissolved Acetylene Project Environmental Statement: Vol. 2 Main Text Consultation Body Date of Response Consultees Responses Comments ES Response Part I B of ODPM Circular 06/2005 Biodiversity and Geological Conservation Statutory Obligations and their Impact within the Planning System describes the procedure for the consideration of plans and projects which may affect sites protected by the Habitats Regulations. Developers and their consultants should make themselves familiar with this procedure so that they are aware of the kind of assessments that the competent authority is required to make and thus the type and quality of information they will be required to provide. SPA birds: � Section 10.14 NE is satisfied that there is enough existing bird data for the development site and surrounding fields and that no additional bird surveys are required. � NE requests more data and detail in the environmental statement (ES) on the recorded numbers of SPA bird species both in the development site itself and the surrounding fields. Breeding birds: � All British birds, their nests and eggs are protected in law. NE recommends that any clearance of trees and areas of scrub should aim to avoid the bird breeding season (March to August inclusive). � NE recommends carrying out a pre-construction survey and if breeding birds are discovered, construction work should be halted and a wildlife licence obtained through NE. The assessment of potential ecological impacts (see Chapter 10 (Ecology)) has been undertaken with full knowledge of this procedure. Comments noted and addressed in Chapter 10 (Ecology) as relevant. Site preparation works, including clearance of any vegetation are expected to occur in Q1 2012, before the breeding bird season. If construction is delayed and vegetation clearance is required during the breeding season, a detailed inspection for breeding birds would be carried out and actions taken accordingly.
