38 13-03-2002 President. - I admire your efforts to make the work of this House rational although there is nothing in the Rules that says we have to be rational. Before the vote on Amendment No. 136: 3-092 Rapkay (PSE). - Herr Präsident! Also hier ist es etwas einfacher als gerade eben. Hier geht es nur darum, dass etwas bereinigt wird. Erstens: Wir wollen mit Nr. 162, gemeinsamer Antrag PSE und PPE, das, was wir beim Strom beschlossen haben, ebenfalls mit dem in Übereinstimmung bringen, was wir jetzt beim Gas beschließen. Es ist wortgleich das, was wir vorher schon beim Strom beschlossen haben. Das bedeutet aber nach der Logik der Abstimmungsliste, dass wir zuerst gegen den Antrag des Ausschusses stimmen müssen und dann für den Antrag 162. Bei der Übermittlung ist jedoch ein Fehler unterlaufen. Wir haben genau dies bei Strom beschlossen, zu Artikel 8 Absatz 5. In Änderungsantrag 162 steht jetzt auch "Artikel 8 Absatz 5". Beim Gas ist es aber nicht Artikel 8 Absatz 5, sondern Artikel 7 a) Absatz 1, und daher muss das natürlich vom Protokoll dort eingefügt werden; das ist nur eine technische Anpassung. Before the vote on Amendment No. 149: 3-094 Rapkay (PSE). - Herr Präsident, es geht wiederum um eine Anpassung, die jetzt allerdings wieder etwas komplizierter ist als gerade eben. (Heiterkeit) Eigentlich brauchen Sie gar nicht zuzuhören, Sie müssen nur das machen, was ich Ihnen vorschlage, dann ist es ganz einfach. (Heiterkeit) Aber Spaß beiseite. Wir haben gerade über den entsprechenden Teil, der den Strom betrifft, abgestimmt. Das findet sich in dem Änderungsantrag des Ausschusses wieder. Der Antrag der Fraktion der Europäischen Volkspartei versucht, eine Unstimmigkeit zwischen Artikel 14, der den Gassektor betrifft, und Artikel 22 aufzuheben, und zwar zu Recht, das muss ich ausdrücklich sagen, um Stringenz zu erzielen. Wenn wir jetzt allerdings nur über den Antrag der PPE abstimmen, dann würde natürlich der wesentliche Aspekt, der den Stromsektor betrifft, untergehen. Umgekehrt, wenn man so abstimmen würde, wie es hier in der Abstimmungsliste steht, dass nämlich bei der Annahme von Nr. 149 Änderungsantrag 184 obsolet ist, dann haben wir wieder das Problem mit der Inkonsistenz zu dem anderen Artikel. Deswegen gibt es folgenden Vorschlag, und den habe ich mit dem Antragsteller abgesprochen, der möge das dann bestätigen: also stimmen wir zunächst über den Änderungsantrag 149 des Ausschusses ab, dann zieht die PPE ihren Änderungsantrag zurück bis auf den Teil, der diese Inkonsistenz aufhebt. Der würde dann anschließend als Hinzufügung an Nr. 149 dazu kommen. Dann hätten wir die Inkonsistenz zwischen Strom und Gas und innerhalb des Gases bereinigt. (Beifall) 3-095 Turmes (Verts/ALE), rapporteur. - Just to confuse my colleagues, it is not exactly correct, because if we vote for the EPP Group's amendment, then we will have a different wording on Article 22 which is the Article on the electricity and gas regulator. I will leave it to the wisdom of the Assembly, but personally, I will vote against this in order to be consistent with Article 22. Bei uns haben sich zwei kleine redaktionelle Fehler eingeschlichen. Der erste Fehler ist in Änderungsantrag 48. Da muss es im Plural "zuständige Behörden" heißen; das war zwischen Rat und Parlament unstrittig. Dies war nur ein Fehler bei der Formulierung des Änderungsantrags. Ebenfalls ein kleiner Fehler ist uns bei Änderungsantrag 52 passiert. Dort sind bei der schriftlichen Formulierung zwei Worte weggefallen. Aber gerade bei Nr. 52 kommt das dem Ausschuss für Umweltfragen, Volksgesundheit und Verbraucherschutz entgegen. Insofern bitte ich, die beiden mündlichen Änderungsanträge zu genehmigen und entsprechend abzustimmen.
