some newspaper published in the City, and to secure thr<br />

more equal representation of each ward in tne city, it<br />

shall be in the power of the corporation to enlarge or diminish<br />

the extent of said wards so that each, as near a<br />

may he, may be made to contain an equal number of inhabitants.<br />

11. Be it further enacted, That, in case of the refusal<br />

of any person to accept the office of Mayor upon his election<br />

thereto or of his death, resignation, inability or removal,<br />

the President of the board of Aldermen shall perform<br />

the duties thereof during the remainder of the term<br />

for which the said Mayor was elected and the President<br />

shall thereupon vacate his seat in the board of Aldermen,<br />

aid in case of the absence or inability of said Mayor, the<br />

said President shail perform all the duties of the Mayor<br />

that may be required to be performed during- his absence<br />

or inability. And the board of Aldermen shall have power<br />

to nil vacancies in their own body by causing- elections<br />

to be made in the manner herein before directed, out of<br />

the citizens qualified to fill the said office in the ward in<br />

which such vacancies shall have happened.<br />

12. Be it further enacted, That, in case no election<br />

shall be holden from unavoidable causes at the time pointed<br />

out by this act, the charter of the corporation shall<br />

not on that account be forfeited, but it shall be the duty oi<br />

the Mayor to name another dav for holding the electior<br />

as near as convenient to the one pointed out by this act,<br />

and which said election, shail be as valid and legal as if<br />

the same had been held at the proper time.<br />

13. Be it further enacted. That, this act shall be anr<br />

continue in force for the term of eight years and no long<br />

cr.<br />
