9. And be it further enacted* That if any candidate choo-<br />

ses to contest the right of any person proclaimed tiuh e-<br />

Jected,to hold his seat in the house of representatives,<br />

such person shall give notice thereof, in writing- to the<br />

person whose election he intends to contest, by leaving a<br />

written notice thereof at tie house where such person last,<br />

resided, within thirty days after '.he date of the Governor's<br />

proclamation, notifying the result of the election, in which<br />

notice, shall be expressed the points on which the same<br />

will be contested, and the name of the Justices of the peace<br />

who will attend at the taking of the depositions, and when<br />

and where they will attend to take the same— provided,<br />

that the time fixed upon for taking such depositions, shall<br />

not exceed ninety days, fiom the cldy of election— and the<br />

said Justices shall have power, and'they are hereby authorized<br />

to issue subpoenas to all persons whose testimony<br />

may be required by either of the parties, commanding such<br />

persons to appear and give testimony at the time and place<br />

therein mentioned, under the penalty of fifty dollars, to be<br />

levied on each and every delinquent who hath been duly<br />

served with process, and the said justices shall hear and<br />

certify under seal all testimony relative to such contested<br />

election, to the speaker of the House of Representatives<br />

of the United States— provided nevertheless, that no testimony<br />

shall be received whirh does not relate to the<br />

points in the notice, a copy of which notice, attested by<br />

the person who delivered or served the same, shall be de-<br />

livered to the said justices.<br />

10. And be it further enacted* That, all the free white<br />

male inhabitants of the ceded ferritories of Florida, above<br />

the age of twenty one, who were here at the cession of the<br />

country to the United States, on the 17th July, 1821, and<br />

all white male citizens of the United States, who may be<br />

residents here at the passage of this—and who have arrived<br />

at the age of 21 years, shall have the right to vote for a<br />

delegate to represent the Territory in the Congress of the<br />

United States.<br />

11. And*jb*it further enacted* That, when objections are<br />

made to a person, offering to vote, and in all other cases<br />

where the qualifications of the person ottering to vote is<br />

touching his qualifications as a voter, agreeably to the<br />

rized to administer, and such person may be further required<br />

to declare on oath or affirmation that he has not already<br />

voted at any other place of election, or has not been<br />

refused for want of due qualifications as a roter.<br />
