-neriff shall neglect or refuse to pay the amount of fines,<br />
.o by him collected, or which ought to have been collect-<br />
ed, on demand being made by the pavmaster of the regiment,<br />
of the county of which he is, or has been sheriff, it<br />
shall be lawful for such pay-master on giving ten days<br />
previous notice to such sheriff, in or out of office, to recover<br />
judgment in a summary way by motion against such<br />
sheriff, in the name of the paymaster, for the use of the<br />
said regiment, to which he may belong, in any court of<br />
record in the county, in which said sheriff or. paymaster<br />
may reside. Also to receive and receipt for all monies<br />
collected, for fines and forfeitures, within his regiment,<br />
and safely to keep the same until drawn out of his hands<br />
by the commanding officer of the regiment or battalion to<br />
which he may be attached, which said warrant shall be<br />
given in writing by the said commanding officer, for the<br />
:ise of the said regiment or battalion, specifying the object<br />
to which the monies so drawn for are to be applied.<br />
The judge advocate shall transmit to the paymaster., all<br />
:he sentences of assessment or appropriations, which<br />
shall from time to time be made by the court martial or<br />
the court of assessment, and it shall be the duty of the<br />
pay-master to receive and -file the same. The pay-master<br />
shall previously to his entering on the duties of his<br />
office, in addition to his other qualifications, prescribed<br />
by this act, execute a bond to the Governor of the Territory,<br />
with security to be approved of by the commandant<br />
of the regiment, in the sura of one thousand dollars for<br />
the faithful discharge of his duties as paymaster. And<br />
he the said paymaster shall annually, in the month of<br />
May, settle with the field officers of his regiment, or a<br />
majority of them; the amount of all monies received and<br />
disbursed by him, and he shall be entitled to receive five<br />
per centum for all monies so by him received and disbursed,<br />
or paid out as above mentioned-; immediately<br />
after which settlement it shall be the duty of iuth paymaster<br />
to report fully ancf at large, a detailed statement<br />
of his accounts to the adjutant general, and also -to the<br />
commanding officer of his corps.<br />
24. Be it further enacted, That, there shall be appoin- Quarter master £«<br />
ted and commissioned by the Governor, one quarter mas- neral, rank and du<br />
ter general with the rank of ^colonel of infantry, in the l,es«<br />
United States army, to whom there shall be annual returns<br />
made by the regimental and brigade quarter masters,<br />
of the state of the public arms and accoutrements,<br />
and other public property applicable to military purposes,<br />
and he shall make report of the same to the executive<br />
of this Territory, and shall do and perform such other<br />
duties, when in actual service, as are prescribed by the re-
