He shall not be capable of acting until he shall have taken<br />

the oath of fidelity to the United States, and also an oath<br />

impartially and honestly to execute the duties of his office.—He<br />

shall moreover give bond with such security as<br />

shall be approved ot by the Governor, in the sum of ten<br />

thousand dollars, payable to the Governor and his successors,<br />

in trust for the use of the Territory, and conditioned<br />

for the faithful accounting for, and paying all such<br />

sums of money as shall be received by him from time to<br />

time, by virtue of any law, and for the faithful, impartial<br />

and honest discharge of all the duties of his said office,<br />

to be recovered upo c<br />

n the breach thereof, by action of<br />

debt, instituted by the solicitor of the Territory, or attorney<br />

of the United States, in any court of record, for<br />

public use.<br />

24. Be it further enacted, That, the said treasurer is<br />

hereby authorized, empowered and required to receive of<br />

the several collectors of the public revenue, all taxes arising<br />

on lands or other property, or from any other source,<br />

and all other public money payable into the treasury by<br />

virtue of any law of the Territory.<br />

25. Be it further enacted, That, the said Treasure?<br />

shall keep in a book or books to be provided for that purpose,<br />

true, faithful, and just accounts of all the money received<br />

by him from time to time, on the respective taxes,<br />

and impositions by virtue of any act or acts of the Territory,<br />

and also of all such sum and sums of money as he<br />

shall pay out of the treasury, pursuant to such act or acts<br />

—which accounts shall be so kept that the nett produce<br />

of the several and respective taxes and impositions, and<br />

he money paid out of the treasury for any particular service,<br />

may appear separate and distinct from each other,<br />

and that he lay a statement thereof before the Governor<br />

and Council, on the sixth day of their annual session.<br />

26. Be it further enacted, That, there be a committee<br />

appointed by the Territorial Legislature, annually, to examine<br />

into the state of the treasury, and the said treasurer<br />

is hereby required to lay before the said committee,<br />

all the accounts and vouchers of the treasury for money<br />

received or paid out for whatever purpose, and to produce<br />

the money in his hands—and the said committee<br />

shall make a fair statement of all monies received and<br />

paid out of the treasury, and for what purposes, and of<br />

the money that shall be in hand, and report the same to<br />

the Legislature, who shall cause the same to be publish-<br />

ed.<br />

27. Be it further enacted, That, if the said treasure;<br />

divert or misapply any of the money paid into the trea-
