25. Be it further enacted, That, ihe commander iu<br />

chief or brigadier general sliall, when they or either of<br />

them may think proper, order general courts martial<br />

composed of officers of any regiment or battalion, or<br />

from different regimems or battalions, which said officers<br />

shal. assemble at such place as the commander in chief<br />

or brigadier general shall appoint, and shall have power<br />

to hear, try and determine all complaints arising under<br />

this act, which may be brought before them, but the sentence<br />

of such court martial shall not be final until approv-<br />

ed, or disapproved by the commander in chief.<br />

26 Be it further enacted, That, the commanding officers<br />

of regiments and separate battalions shall have power<br />

to order regimental courts martial, i'o\- the trial of captains<br />

and subalterns, the sentence of which shall not be fi-<br />

nal until approved or disapproved by the commander in<br />

chief.<br />

27. Be it further enacted, That, three days succeeding<br />

a regimental muster, a court for the assessment uf lines<br />

shall be held by the commissioned officers of such regiment<br />

or any five of them. The highest officer in rani; of<br />

such regiment or battalion that may be present, shall be<br />

president. And the said court when convened shall have<br />

power to enquire into inability and delinquencies, that<br />

may have happened at any of the preceding musters, and<br />

also all neglects or omissions of officers as well as pri-<br />

vates. The judge advocate shall act as clerk to each regimental<br />

court martial, or court for the assessment of<br />

fines, and court of appeals, to which he belongs, and shall<br />

record in a book to be by him kept for that purpose, the<br />

whole proceedings of such court, which proceedings at<br />

the close of each court shall be signed by the president of<br />

such court martial, or court for the assessment of fines,<br />

and countersigned by the judge advocate. The judge advocate<br />

shall be exempted from parade duty, and have an<br />

allowance made by the court not exceeding two dollars<br />

per day. It shall be the duty of commandants of regiments<br />

and battalions from time to time to certify to the<br />

paymaster, the amount of »uch sum as the judge advocate<br />

may be entitled to, and to issue a warrant for the<br />

payment thereof.<br />

28. Be it further enacted, That, the president of such<br />

court assembled for the assessment of fines an-1 the punishment<br />

of delinquencies, shall administer to the judge<br />

advocate the following oath or affirmation, to wit, li you<br />

solemnly swear or affirm (as the case may be) that you<br />

will faithfully execute the office of judge advocate to this<br />

court, that you will keep an exact record of all their proc<<br />

din rs Iron time to time, and not disclose or discover<br />

the opinion of the court, (when secrecy may be required}
