a • ioieut intention, he, she or they, so offending,<br />
upon conviction thereof, shall moreover stand in the pillory<br />
fov the space of three hours., and he imprisoned not<br />
exceeding seven years, in addition to tie former punishment.<br />
And if the death of any innocent person shall ensue<br />
from the breaking and entering any dwelling house,<br />
shop, store, ov vessel as aforesaid, in any of the instances<br />
as aforesaid, the perpetratoi and the accessary, before the<br />
fact, shall be deemed guilty of murder.<br />
24. Be itfurther enacted* That if any person or persons<br />
shall feloniously and forcibly take any money, goods<br />
or chattels, or effects from the person of another in the<br />
field or highway, or any other place, he, sne or they so offending,<br />
snail be deemed guilty olrobbery, and on conviction<br />
shall suffer as in the second instance of burglary.<br />
Whosoever snail commit such robbery, with personal abuse<br />
or \iiolence, or be armed at the time with any dangerous<br />
weapon, so as clearly to indicate an intention of<br />
violence, he, she or they so offending, upon conviction<br />
thereof, shall suffer as in the third, instance of burglary.<br />
And if the death of an innocent person shall ensue from<br />
such robbery, the perpetrator or perpetrators, and the accessaries<br />
before the fact, shall be deemed guilty of murder.<br />
25. Be it further enacted, That, if any person or persons<br />
shall steal from any dther person or persons, or from<br />
the dwelling house, or other house of any person or persons,<br />
any money, goods, wares and merchandize, or any<br />
other personal property, or thing whatever, lie, she or<br />
they so offending, shall be deemed guilty of Larceny, and<br />
upon conviction thereof, shall for the first offenee restore<br />
to the owner the thing stolen, and pay to him the value<br />
thereof, and if the thing stolen be not restored, shall pay<br />
to him double the value thereof, and shall be fined in any<br />
sum not exceeding double the value oft .e thing stolen.<br />
and shall be. whipped not exceeding thirty nine stripes,<br />
and -stand in the pillory not exceeding two hours, and upon<br />
a second conviction, restitution or payment shall he<br />
made to the owner as aforesaid, and a fine paid to the<br />
Territory not exceeding four fold the value thereof as afo<br />
res aid j and tne offender shall be whipped not exceeding
