38. Be it further enacted. That if any person or persons,<br />
shall knowingly and wilfully obstruct, resist or oppose<br />
any officer of this Territory, in serving or attempting<br />
to serve or execute any original, mesne or final process<br />
or warrant, or any rule or order, of any of the courts<br />
of the Territory, or any other legal or judicial writ, or<br />
process whatsoever, or shall assault, beat or wound any<br />
afficer, or other person duly authorized, in serving or executing<br />
any writ, rule, order, process or warrant aforesaid,<br />
every person so knowingly and wilfully offending,<br />
in the premises, shall on conviction thereof be imprisoned,<br />
not exceeding twelve months, and fined not exceeding<br />
three hundred dollars.<br />
39. Be itfurther enacted, That, if any person or persons<br />
agree, or compound \o take satisfaction for any<br />
criminal offence, such person or persons shall forfeit<br />
twice the value of the sum or thing agreed for or taken,<br />
but no person shall be debarred from taking his goods or<br />
property from he thief provided he prosecutes such thief.<br />
40. Be it further enacted, That no person shall take upon<br />
himself to exercise, or officiate, in any office or place<br />
of authority in this Territory, -without being lawfully authorized<br />
thereto, and if any person shall presume so to do,<br />
he shall upon conviction thereof be fined in a sum not<br />
exceeding one hundred dollars.<br />
41. Be> it further enacted, That^ riots, routs, and'unlawTul<br />
assemblies, shall be punished by fine at the discre-<br />
tion of a jury.<br />
42. Be it further enacted, That, if any person or persons,<br />
within this Territory, being married, or who shall<br />
hereafter marry, do at any time marry, any person or persons,<br />
the former husband or wife, being alive, upon conviction*<br />
thereof, shall b»whipped on his or her bare back,<br />
not less than one hundred stripes welj laid on ; be fin^d in<br />
not less 1<br />
than one hundred, nor more than five hundred<br />
dollars, to and for the.use of the^party injjjflred, and imprisoned<br />
not less than six, nor more than twelve months, and<br />
therijafter be rendered infamous ; be incapable of giving<br />
testimony, or holding any commission civil or military in<br />
this Territory And the party and parties so offending<br />
shall receive such like proceedings, trial' and execution<br />
within this Territory, as if the offence toad been committed<br />
in the countv, where such person shall be taken or apprehended.<br />
Provided, that, nothing herein contained<br />
shall extent) to any person or persons, whose husband or<br />
wife shall be continually remaining beyond the seas, for<br />
the space of seven years together, or whose husband or<br />
wife shall absent him or herself, the one from the other for<br />
the space of seven years together in any part of the United<br />
States of America, or elsewhere, the one of them not<br />
knowing the other of them to be living within that time.<br />
Provided, also, that nothing herein contained, shall extend
