2. Be itfurther enacted^ That, when any person is sued<br />
on a bond or other writing, by an assignee thereof, it shall<br />
rot be lawful for the defendant to require of the plaintiff,<br />
proof of the assignment until the defendant shall deny the<br />
same on oath, by plea, alledging that he verily believes the<br />
assignment to be forged.<br />
3. Be itfurther enacted, That, it shall not be necessarv<br />
in an action upon an assignment of any instrument of writing,<br />
assignable by law, to set forth in the declaration the<br />
consideration upon which such assignment has been<br />
made.<br />

AN ACT<br />
Regulating damages on Bills of Exchange.<br />
1. Be it enacted by the Governor and Legislative Council<br />
of the Territory of Florida, That, when anv person<br />
within this Territory shall draw or endorse any bill or<br />
bills of exchange, upon any person or persons residing<br />
out of the United States, or the Territories thereof, and<br />
the same be returned back protested, and unpaid, the<br />
drawer thereof and all others concerned shall pay and discharge<br />
the contents of the bill, or bills, together with<br />
twenty percent advance for the damages thereof, in money<br />
equivalent to that paid to the drawer or endorser.<br />
2. Be it further enacted, That, if any person shall draw<br />
a bill of exchange upon any person residing out of the<br />
Territory, and within the United States, and the same<br />
shall be returned unpaid, with legal protest, the drawer<br />
thereof and all others concerned in drawing and endorsing<br />
the same shall pay and discharge the contents of said<br />
bill, and ten per cent for the damages thereof with costs of<br />
protest.<br />
3. Be it further enacted, Thatupon all bills of exchange<br />
made negotiable by law or by the usages and customs of<br />
merchants, as recognized by the lex mercatoria, there<br />
shall only be allowed three days of grace, any custom to<br />
the contrary notwithstanding.<br />
