12.<br />
12. And be it further enacted. That, if any judge of the<br />
election or clerk, or any other officer concerned in conducting<br />
the election, shall neglect, improperly delay, or<br />
refuse to perform any of the duties or services required by<br />
this act, having undertaken so to do, or shall knowingly<br />
admit any person to vote, not qualified according to law, or<br />
shall be guilty of corruption, partiality or manifest misbehavior,<br />
in any matter or thing appertaining to said election,<br />
or shall knowingly receive any improper votes, or<br />
shall knowingly make a false return of the votes given, he<br />
or they so offending shall forfeit and pay each to the Territory<br />
a sum not exceeding % 200, nortess than % 50, to be<br />
recovered in any Court of record in the Territory, in the<br />
name and for the use of the Territory, in an action of debt<br />
with costs of suit, or atthe suit of any person who may see<br />
proper to sue for the same, one half for the use of the person<br />
suing, and the other half for the use of the Territory.<br />
13. And be itfurther enacted, That, the sum of S 600<br />
dollars be, and the same is hereby appropriated out of any<br />
money in the Treasury, not otherwise appropriated for the<br />
purpose of defraying the expenses of the electiou of delegate,<br />
which said sum of % 600 dollars is hereby placed at<br />
the disposal of the Governor, to be by him expended, or<br />
so much thereof as he may deem necessary, in paying the<br />
expenses of the election, in such manner as he may judge<br />
proper.<br />
