and certifying the same to be tiue, shall forfeit ana pay<br />

for each and every offence, so committed, a sum of money<br />

not exceeding five thousand nor less than one hundred<br />

dollars at the discretion of the judge of the Court, before<br />

whom he shall be convicted, to be recovered in the n~me<br />

of the Territory before any court of record in this territory,<br />

and shall moreover be liable to an action for damages at<br />

the suit of the party, or parties, who may sustain any<br />

damage or injury thereby.<br />

4. Be it further enacted, That the keeper of the public<br />

archives in Fensacola shall execute a bond with security<br />

to be approved of by the jiuiee of the Circuit Court of the<br />

Counties of Escambia and Jackson, and to be deposited<br />

in tii° office of the Secretary of the Territory, in the penalty<br />

of five thousand dollars payable to tht Governcw of<br />

Florida or his successors in office, conditioned for the<br />

faithful discharge of the duties enjoined by this act, and<br />

the keeper of the public archives in St Augustine shall<br />

execute a like bond to be deposited as aforesaid, and to be<br />

approved of by the judge of the Circuit Court for tne<br />

Counties of Duval and St. Johns.<br />

5. Be it further enacted, That, the said keepers of the To take an oath.<br />

public archives shall each severally take on oath or affirmation,<br />

before any person in this Territory qualified by<br />

law to administer the same, faithfully to do and perform<br />

the duties of his office enjoined by this act, a certificate of<br />

which oath or affirmation shall be filed in the office of the<br />

clerk of the Circuit Court for the County in which said<br />

oath or affirmation shall have been taken.<br />

6. Be it further enacted, That, the said keepers of the KnoYs & c . tobe<br />

public archives shall cause all such papers and documents<br />

as are the subjects of usual reference, to be bound<br />

in a book or books and for defraying the expense thereof<br />

a sum of money not exceeding two bundled dollars, be<br />

and the same is hereby appropriated out of any moi ?y in<br />

the treasury not otherwise appropriated, to be placed at<br />

the disposal of the said keepers of the public archives;<br />

one hundred and twenty dollars, to be expended bv the<br />

keeper of the public archives at St. Augustine, and eighty<br />

dollars to be expended by the keeper of the public archives<br />

at Pensacola, who shall severally aeeoi«nf for the<br />

expenditure of the same to the proper accounting officers<br />

of this Territory.<br />
