law, for the appointment of officers, and that hereafter all Non-commissioned<br />

sergeants and corporals, shall be appointed by the captains<br />

or commanding officers of companies respectively,<br />

and the lieutenant colonel shall perform all the duties of<br />

a major, to the first battalion of the regiment to which he<br />

belongs according to law.<br />

48. Be it further enacted, That, hereafter the commissioned<br />

officers, non-commissioned staff, non-commissioned<br />

officers and musicians of each regiment shall appear<br />

once in each and every year, at the usual place of holding<br />

regimental musters, in their respective regiments, on the<br />

first and second days, previous to the regimental musters<br />

for the purpose of being drilled and instructed in the military<br />

duties as the law directs, and the brigade inspector<br />

shall attend and perform the duties of exercising and instructing<br />

the corps, and if the brigade inspector does not<br />

attend such drill muster, then it shall be the duty of the<br />

senior officer present to perform the duties which are required<br />

to be performed by the brigade inspector, and<br />

such drill muster shall continue two days successively,<br />

and all commissioned officers, non-commissioned staff,<br />

non-commissioned officers and musicians, who shall fail<br />

to appear at any drill muster for the purpose of being instructed<br />

in the military duties, so directed by this act,<br />

shall be proceeded against and fined in the same manner,<br />

as is provided by this act.<br />

49. Be it further enacted, That, from and after the pas- Sheriff's foes<br />

sage of this act, the sheriffs fees for the collection of fines<br />

shall be five per centum on the amount of fines collected :<br />

Provided however, that in all cases when property is executed<br />

and sold, the sheriff shall have the same fees and<br />

commission to be paid by the delinquent as is allowed on<br />

executions.<br />

50. Be itfurther enacted, That, the following shall be<br />

the form of a company return.<br />
