public places in his district.<br />
8. Be itfurther enacted, That, it shall be the duty of<br />
each and every person subject to taxation, to attend at the<br />
time and place required by this act, and give in a full and<br />
fair list in writing, of all persons and property he is bound<br />
to pay taxes for, by any of the Territory.<br />
9. Be it further enacted, That, it shall be the duty of<br />
the person so appointed, to attend at the time and place<br />
required by this act, to take in and receive lists of taxable<br />
property from all such persons as shall attend to give in tiie<br />
same, and the said commissioner is authorized and required<br />
to administer to each person giving in his or her list<br />
of taxable property, the following oath or affirmation, to<br />
wit, " I, A. B. do solemnly swear or affirm (as the case<br />
may be) mat this list contains a true and perfect account,<br />
of all persons, and every species of property belonging to<br />
me, or in my possession, subject to taxation on the first<br />
day of October last, and that no contract, change or removal<br />
whatever, of property, has been made or entered<br />
into, or any other mode, devised or used, in order to evade<br />
the payment of taxes".<br />
10. Be itfurther enacted, That, each person subject to<br />
taxation, who shall fail or refuse to attend at the time,<br />
and place herein required to give in said list, shall have<br />
till the first Monday of February thereafter, to attend at<br />
the house of the commissioner; and give in said list as<br />
aforesaid, or to transmit it accompanied with such oath.<br />
as is herein required.<br />
11. Be it further enacted, That, if any person shall<br />
give ; n to said commissioner, a fraudulent list of taxable<br />
property, or shall fail to give in when required, or transmit<br />
a list of his taxable property, on oath or affirmation,<br />
agreeable to the provisions herein, the person so failing,<br />
without a good excuse to be adjudged of by the county<br />
court, or so giving in a fraudulent list, "shall be fined five<br />
dollars, and moreover liable to a double tax—and the<br />
commissioner shall proceed to list hisor her property agreeably<br />
to the best information he can obtain—which<br />
fine and double tax, shall be recovered in the county court<br />
on motion, in writing, of the solicitor, upon giving the<br />
defendant fifteen days previous notice in writing, of said<br />
motion—and shall be collected and accounted for by the<br />
collector, as other taxes are—and the clerk shall certify<br />
to the Treasurer, such fine and double tax.<br />
12. Be it further enacted^ That, the commissioner so appointed,<br />
after having collected the lists of taxable property<br />
