Art. 4. There shall be a secretary to the said Board, to<br />
be appointed oy a majority of the members, at their first<br />
meeting-, who shall receive such compensation as the<br />
Board may think right, and it shall be his duty to keep a<br />
faithful record of tneir proceedings. The said Secretary<br />
shall also be treasurer of said Board, and shall give security<br />
in the sum of three*.thousand dollars, for the faithful<br />
performance of the duties of his office as such, and<br />
shall receive a compensation of five per cent, on all mo-<br />
nies received by virtue of his said office.<br />
Art. 5. The record of the proceedings of the said Board<br />
shall at all times be open to the Governor and Secretary<br />
of the Territory, and tne judges of the Superior<br />
cuit Courts.<br />

Art. 6. It shall be the duty of the "Board of Health of<br />
Pensacola', and the "Board of Health of St. Augustine"<br />
to address respectful -memorials to the Congress of the<br />
United States, at their next session, asking a donation of<br />
fifty acres of land, at the points at which they may think<br />
proper to establish the quarantine ground, and also to<br />
solicit their aid in the erection of suitable buildings<br />
for the reception of the sick and other persons who may<br />
be detained there, and a store for the reception of the<br />
merchandize unladen there—which places shall be called<br />
the ''quarantine ground."<br />
Art. 7. The Governor shall appoint a Health officer to<br />
each Board of Health, removable from office on an address<br />
agreed on by three fourths of the members of the<br />
Board of Health, and each Board shall appoint two health<br />
wardens, and a steward who shall hold their offices during<br />
the pleasure of the Board of Health.<br />
Art. 8. The Board shall have power on the report of a<br />
member, or one of the health wardens, to make orders directed<br />
to the owner or occupant of any ship, boat, apartment,<br />
house or lot, for the removal of any substance<br />
which in their opinion shall be dangerous to the health of<br />
the city ; for the cleaning, washing and whitewashing of<br />
any house or apartments, or ships, or vessels, for the removal<br />
of the contents of any privy, or the filling up of any<br />
sink, for the destruction or cleaning of any beds, bedding<br />
or clothing, which in their opinion may contain infectious<br />
or contagious matter ;<br />
and if such order be not complied<br />
with, within a reasonable time, to be specified in the same,<br />
to cause the same to be done at the expense of the party<br />
offending, by warrant, (describing the thing to be removed<br />
or cleansed, or destroyed,) directed to one of the<br />
health wardens. And the party thus offending to be fined<br />
by the board of health, in a sum not exceeding fifty dollars.<br />
Art. 9. Whenever it shall be certified to the board of<br />
health, that any person not being domiciliated in the city,
