act, shall order a court martial or court oi enquiry, for the<br />
investigation of the officer, or trial, as the case may appear<br />
to require. Every officer to be tried by a court martial<br />
shall have ten days notice given him of the time<br />
and place appointed for the trial and shall have a copy of<br />
the charges exhibited against him ten days at least before<br />
the sitting of the said court. In every court martial<br />
for the trial of an officer not less than two thirds of the<br />
members present shall agree in the sentence or judgment<br />
of said court, otherwise the person charged shall be acquitted<br />
; and when the members shall be required to give<br />
their votes on a question or discussion, they shall begin<br />
with the youngest in commission : Provided, that no<br />
commissioned officer shall be allowed to resign his commission<br />
whilst under arrest.<br />
IS. Be it fur the?- enacted, That, when a brigade, regiment,<br />
or battalion, assemble for review, inspection or ex-<br />
ercise, the commanding officer shall order a guard of a<br />
subaltern or sergeant and such number of men as he may<br />
deem necessary, whose duty it shall be to receive and<br />
guard all such persons as shall be ordered under their<br />
charge by the commanding officer or inspector for misbehaving<br />
or refusing to attend to discipline in exercising<br />
and performing all those evolutions and other duties which<br />
may be required of them by this law.<br />
19. Be it further enacted, That, if any officer shall be<br />
guilty of a breach of this law, or in any respect neglect<br />
or violate his duty, or be guilty of any ungentlemanly<br />
conduct, he shall be heard, tried, and if found guilty, sentenced<br />
at the discretion of a court martial.<br />
20. Be it further enacted, That parents shall be bound<br />
for payment of fines incurred by their sons under the age<br />
of twenty-one years, guardians for the payment of fines<br />
incurred by their wards, and masters or mistresses for<br />
the payment of fines incurred by their servants or apprentices,<br />
and they shall be respectively charged therewith<br />
by the court of assessment accordingly.<br />
21. Be it further enacted, That, it shall be the duty of<br />
the adjutant of each regiment to keep a register of the<br />
officers belonging to his said regiment, for courts martial<br />
and courts for the assessment of fines.<br />
22. Be it further enacted, That, the field officers oi<br />
each regiment, or a majority of them, shall appoint a fit<br />
person as judge advocate, of the regiment, whose duty it<br />
shall be to prosecute in behalf of the United States, and<br />
also to perform such other services as mav be prescribed<br />
by law.<br />
23. Be itfurther enacted, That, it shall be the duty oi<br />
the paymaster of each regiment, independently of such<br />
duties as may be required of him by the commander ii<br />
ehief, to demand and receive from the different sheriffs,
