AN ACT<br />

,. Be Li enacted by the Governor and Legislative Coun-<br />
the Territory of Florida, That, every able bodied<br />
white male inhabitant of this Territory, between the<br />
; ges of eighteen and forty live years, shall be liable to<br />
perform militia duty, to be enrolled by the captain or comin<br />

may reside. It shall be the duty of said officers respectively<br />
to enrol every such inhabitant, as also such persons<br />
who shall from time to time arrive at the age of<br />
eighteen years, as well as those persons who come to reside<br />
within his bounds or limits— and it shall be the duly<br />
of the captain or commanding officer of each compa-<br />

Provided that no person shall be called upon to perform Proviso<br />
militia duty who has not resided at ieast two months<br />
within this Territory, and ten days within the proper<br />
bounds of his company, except in cases of actual or<br />
threatened invasion, when any such person on proper no.<br />

;ain or commanding officer within whose bounds he may<br />
reside, and be subject to the same fines and penalties as<br />
are hereafter provided— and provided also, that the<br />
judges of the district and circuit courts and their clerks,<br />

exempted from militia duty— also all<br />
sheriffs, ordained ministers of the Gospel, teachers of<br />
public seminaries and keepers of jails, except in time of<br />
war or insurrection;— But it may be lawful for any of the<br />
above named persons to accept of commissions in the<br />
militia.<br />
2. Be it further enacted, That, the said Territory shall<br />
be divided into two brigades, to be under the command<br />
of brigadier generals, one brigade to be composed of the<br />
counties of Escambia and Jackson to be called the first<br />
brigade, the other to be composed of the counties of St.<br />
John's and Duval, to be called the second brigs<br />
brigade to be composeo of not less than two nor more<br />
than four regiments, each regiment of two battalions,<br />
each battalion of not less than four companies, and each<br />
company of one captain, one first and cm: second lieutenmt,<br />
