aforesaid to view any road shall fail or neglect to perforathe<br />

uuties required of them by law, each and every overseer<br />

or commissioner so failing or neglecting shall for-<br />

feit and pay a sum not exceeding1 fifty dollars, to be recovered<br />

by presentment by the grand jury in the count}<br />

court of tiie proper county.<br />

17. Be it further enacted, That, all fines and forfeitures<br />

which may hereafter be incurred, under the provisions<br />

of this act, shall be paid into the county treasury, and<br />

after the payment of tiie overseer, as is provided for by<br />

this act, shall be and the same is hereby directed to be appropriated<br />

to the improvement of the several public roads<br />

and highways, in the counties in which the same may<br />

have been incurred, either by hiring horses, waggons, labourers<br />

or otherwise as the overseers of the several roaci<br />

divisions or districts shall deem most advisable and proper<br />

and an order for such overseer shall be a sufficier.voucher<br />

to the county treasursr for the payment thereof<br />

18 Be it further enacted, That, no person or person -<br />

shall keep a ferry in this Territory, so as to demand o.<br />

receive pay, without a special licence first had and obtained<br />

from the county court of the county where such<br />

ferry may be; and the said court are hereby empowered<br />

on the payment of such sum as the said court shall deem<br />

reasonable, not less than two dollars nor exceeding- one<br />

hundred dollars, for the use of the county to grant a licence<br />

to each and every person applying, who shall be<br />

judged suitable for such service by the same court, for<br />

the term of one year from the time of giving such licence,<br />

to keep a ferry at such place as the said court shall judge<br />

necessary. And the court shall state the fare and ferriage<br />

at each ferry, for passengers, horses, and other creatures,<br />

carriages, waggons, carts, teams, and other things transported,<br />

always having regard to the breadth and situation<br />

of the stream, and the publicity of the ferry: and provided<br />

always that every person having applied for a licence<br />

as aforesaid, shall before the same shall be granted, give<br />

bond with sufficient securities to the clerk of the county<br />

court of the county wherein such ferry may be and to his<br />

successors in office, in such sum as the said court shall<br />

order, conditioned for the faithful performance of the du-<br />

ties of his place.<br />

19. Be it further enacted. That, it shall be the duty oi<br />

the court, granting licences for keeping ferries, to compel<br />

the person obtaining tne same to pay therefor, for each<br />

year, any sum not less than two dollars and not exceeding<br />

the sum of one hundred dollars, and under every restriction<br />

and condition by law provided concerning the grant<br />

ing of licences.
