The fees to the Clerk, prior to tiie return and entry of the<br />
award, shall be jointly paid down by the parties as those<br />
services are rendered, but after the award is entered of<br />
record, all subsequent costs shall be charged to, and collectable<br />
from the party against whom the judgment or<br />
decree of the Court, shall be under such award, unless it<br />
be otherwise directed in said award.<br />
6. Be it further enacted, That, witnesses shall be allowed<br />
the sa.ne compensation and privileges as witnesses attending-<br />
Courts.<br />
7. Be it further enacted, That, in case the arbitrators<br />
cannot agree, they may call in an umpire, and the derision<br />
so made, shall be as valid as if made by the original ar-<br />
bitrators.<br />

AN ACT<br />
Appointing" Commissioners to view aroadfromPensacola to Cahawbr..<br />
Whereas it is represented that the Legislature of Alabama,<br />
has directed a road to be opened from Cahawba in<br />
that State to Pensacola, and a direct communication between<br />
those places, being an object of much interest to the<br />
citizens of Florida. Therefore be it enacted by the Governor<br />
and Legislative Council of the Territory of Florida?<br />
That Clark Jackson and Celestine Gonzales, be and they<br />
are hereby appointed Commissioners to view and mark<br />
out the nearest and best rout for a road from Pensacola to<br />
the boundary line between Florida and Alabama, to meet<br />
the commissioners appointed for said purpose by that state,<br />
and that they make their report on oath to the first term<br />
of the County Court, after having viewed and marked out<br />
such way, and the County Court is hereby directed to<br />
cause said road to be cut out, if in their estimation ad-<br />
visable, as soon as practicable thereafter, and kept in repair<br />
in the manner, and under the regulations prescribed<br />
by law.<br />
