9. Be it further enacted, That, the said justices respectively<br />

shall have power to fine and imprison for contempts<br />

offered while acting in their judicial capacity:<br />

provided said tine do not e*xceed five dollars nor said imprisonment<br />

twenty four hours.<br />

10. Be it. further enacted. That, they shall also, each,<br />

have power to take recognizance for keeping of the peace,<br />

and for good behaviour, which shall require the defendant<br />

'o appear at the next circuit court, and be their returnable—They<br />

shall have power to issue warrants on information<br />

upon oath or on their own knowledge, against any<br />

person or persons who have been guilty of a breach of the<br />

neace, requiring him or them to appear before the justice<br />

who issued it, or some other justice of the county, there<br />

to be recognized to appear at the next circuit court to be<br />

held for the county, to be tried according to law—and on<br />

failure of the person or persons to g-ive security, so to<br />

appear, the said justice shall commit him or them to jail<br />

*\\\ court, or until such security be given.<br />

11. Be it further enacted, That, the said justices of the<br />

peace shall respectively possess and may exercise all the<br />

powers usually and legally exercised by justices of the<br />

peace of the United States under the common law.<br />

12. Be it further enacted* That, the said justices of the<br />

peace within their respective counties, or any three of<br />

them, shall constitute and compose a county court for<br />

each county respectively, and they shall hold their terms<br />

on the first three days of every circuit term in each county<br />

if the business so long- require it—and the judge of the<br />

rircuit court when present shall be the presiding judge of<br />

said court.<br />

13- Beitfurther enacted* That, the said court shall and<br />

may take cognizance of all matters and things relating to<br />

the opening and keeping in repair of roads within their<br />

counties, appointing overseers or surveyors of said roads,<br />

establishing ferries, erecting and keeping in repair<br />

bridges and causeways, and granting writs of ad quod<br />

damnum, for the erecting of mills and other waterworks,<br />

and for the maintainance and support of the poor and infirm<br />

of their county. The said court, or a majority of all<br />

the justices of the county being present, and concurring<br />

therein, shall have power to levy and collect a poll lax for<br />

the erection or repair of the necessary public buildings of<br />

the counly, such as a court house, jail and clerk's ofrice,<br />

building bridges where necessary and proper, and for such<br />

other purposes as may be designated by law. The said<br />

court shall also have power to appoint as many constables<br />

in the county as they shall deem necessary and the<br />

business and the interest of ih* said county may require,<br />

and also a jailor. In opening and repairing roads perianal<br />

service alone shall be required, or a commutation<br />
