10. Be it further enacted, That the Governor shall an- Adiutant general.<br />
•}0int and commission an adjutant general, with tiie rank<br />
oi'colonel, who shall perform ail, and singular the duties<br />
enjoined on an adjutant general by an act of congress entitled<br />
" an act to provide more effectually for the national<br />
defence establishing an uniform militia throughout the<br />
United States," and by an act in addition to the act before<br />
^ecited. The brigadier general shall appoint one aid-decamp,<br />
and shall appoint one brigade inspector and one<br />

quarter master of brigade to each brigade, who shall be master.<br />
'.ommissioned by the governor. It shall be the duty of<br />
the brigade inspector to attend the regimental and battalion<br />
musters of the militia in his brigade, to inspect their<br />
arms, amunition and accoutrements, and superintend their<br />
exercise and manoeuvres, and introduce the proper svstem<br />
of military discipline, and to make returns to the<br />
adjutant general, of the state of the militia, once a year,<br />
in addition to the return of the strength of his brigade, before<br />
required, reporting therein the actual situation of<br />
the arms, accoutrements, ammunition of the several<br />
corps, and every thing which in his judgment may relate<br />
to their government, and the general advancement of<br />
,-ood order and militia discipline.<br />
i I. Be it further enacted, That, where the Militia laws<br />
of the United States may not have detailed the duties of<br />
the respective officers in relation to the discipline of the<br />
Militia, such duty shall be determined by reference to the<br />
discipline established for the regular army.<br />
\2. Be it further enacted, That, the Adjutant General<br />
or brigade inspector, for a violation or neglect of the dunes<br />
imposed on them by law, shall incur a penalty not<br />
exceeding one hundred dollars, nor under thirty, any<br />
commissioned, or staff officer failing to perform the duties<br />
required of him respecting the appointment and giving<br />
notice of regimental, battalion, or company musters,<br />
or for his non-appearance at such muster, in uniform, and<br />
equipped as the law directs, or for his failing to make<br />
these reports, which by law he is directed to make, shall<br />
forfeit and pay as follows, that is to say, a commandant<br />
of a regiment, or brigade inspector, the sum of fifty dollars,<br />
major of a battalion forty dollars, the commanding<br />
officer of a company, or adjutant, the sum of twenty dollars,<br />
a lieutenant or ensign the sum of ten dollars, and<br />
those officers respectively, moreover be liable to be cashiered<br />
at the discretion of a court martial. Kach noncommissioned<br />
