action of tresspass, ejectment, or writ of right.<br />
19. rfe it further enacted. That, every juror summoned<br />
to aiiend the justices aforesaid, and failing to attend<br />
without sufficient c^use therefor, shail be liable tu a fine<br />
of sixteen dollars, to the use of the Territory, imposed by<br />
th< justices aforesaid.<br />
£ ). Lt it further enacted, That, the sheriff or other<br />
prober o nicer, shall be aiiowed, for his services, in executing<br />
and returning the warrant aforesaid, the- sum of three<br />
dollars. Ail other fees of officers for services rendered,<br />
in relation to the proceedings and trial aforesaid, shall be<br />
the sain* a> the fees for similar services, rendered in a<br />
sun respecting the title of land, depending in a<br />

21. Be it further enacted, That, this act shall commence<br />
and be in force from and after the passing there-<br />

AN ACT<br />
For the punishment of slaves, tor violations of the penal laws of this<br />
Territory.<br />
1. Be it'enacted by the Governor and Legislative Coun-<br />
cil of theTerritory of Florida, That, for all capital offences<br />
slaves shall be indicted, tried and punished in the<br />
same manner as white persons, in the circuit courts of<br />
each county in this Territory.<br />
2. Be itfurther enacted, That, for the crimes of murder,<br />
manslaughter, rape, arson, burglary, poisoning and<br />
rebelling against their masters, any slave or slaves being<br />
thereof convicted, shall' be deemed guilty of felony without<br />
the benefit of clergy, and shall surTer death.<br />
Z. Be itfurther enacted, That, for all other offences against<br />
the penal laws of this Territory, whether crimes or<br />
misdemeanors, shall be tried and punished before a justice<br />
of the peace and the punishment shall not exceed sixty<br />
lashes.<br />
4. Be it further enacted, That, whereas many times,<br />
slaves run away and lie hid and lurking in swamps, woods<br />
and other obscure places, killing hogs, and committing<br />
other injuries to the inhabitants of this Territory ; in all<br />
such cases, upon intelligence given oftwoormore slaves<br />
lying out as aforesaid, any two justices of the peace of the<br />
county wherein the slaves are supposed to lurk or do mis-<br />
