43. Be it further enacted^ That, it shall be the duty oi'<br />
the sheriff of each county, ninety days alter the list oi' fines<br />
assessed, by a court martial, or court for the assessment<br />
of tines, has been transmitted to him, for collection, to pay<br />
over the amount of such fines, to the paymaster of ihe<br />
regiment, and in case said sheriff shall fail or neglect to<br />
collect and pay over the same according to the provisions<br />
of this act, such delinquent sheriff shall be charged by<br />
the paymaster with the sum of five per centum per month<br />
on the sum or sums he has thus failed to account for :<br />
Provided, that it shall be the duty of commanding officers<br />
of regiments or separate battalions to give credit to said<br />
sheriff for the amount of the sum or sums he shall not be<br />
able to collect, on accounts of delinquencies, he shewing<br />
on oath that he has used his best endeavours to collect<br />
the same.<br />
44. Be it further enacted, That, in case any person fined<br />
as provided by this act, shall go to reside in another<br />
county, without having complied with the sentence of the<br />
court martial, or court for the assessment of fines, it shall<br />
be the duty of the officer cnmrm.nling the regiment or<br />
separate battalion in which the delinquent was enroled,<br />
to forward a copy of the said sentence to the sheriff of the<br />
county where the said delinquent is residing when known.<br />
And it shall be the duty of said sheriff to have the same<br />
collected and returned within six months, to the paymas-<br />
ter of the regiment where such delinquent was fined.<br />
45. Be itfurther enacted, That, all orders given by the<br />
commander in chief of this Territory in pursuance of this<br />
act, through his aid de camps or the adjutant general, or<br />
directly from himself shall be obeyed and respected<br />
throughout this Territory, and that all orders given by<br />
each brigadier general in his brigade; in pursuance of<br />
this act, through his aid de camp or brigade inspector, or<br />
directly from himself, and all orders given by the commanding<br />
officer of a brigade through the brigade inspector<br />
or directly from himself shall be obeyed and respected<br />
throughout his said brigade.<br />
46. Be itfurther enacted, That, whenever in any of the<br />
several counties of this Territory, the sheriff' shall make<br />
report according to the form prescribed by the thirty seventh<br />
section of this act, that he has in his custody one or<br />
more persons charged with any capital offence against the<br />
laws of the United States or of this Territory, and that<br />
there is no jail in said county, a guard shall be granted<br />
according to the provisions of the aforementioned section.<br />
47. Be it further enacted, That, hereafter the field officers<br />
of each regiment in this Territory, shall consist of<br />
one colonel commandant, one lieutenant colonel and one<br />
major to be commissioned by the Governor, subject to the<br />
same restrictions and provisions as are now provided by
