shall be attached to the regiment in the bounds where the<br />
captain commanding- the same may reside, and be subject<br />
to the same rules and regulations of the said regiment.<br />
35. Be it further enacted. That, all persons desirous of<br />
forming troops or companies of horse or artillery, and<br />
who shall associate themselves, shall subscribe certain<br />
rules and regulations for their government, which, when<br />
sanctioned by the commander in chief, shall be binding on<br />
them. All such volunteer companies shall act, muster<br />
and parade by the special order of the adjutant general,<br />
or commander in chief, independently of, and in addition<br />
to those duties, which they are bound to perform by the<br />
company regulations, and by the provisions of this act.<br />
Every trooper who shall enroll himself for this service,<br />
having furnished himself with a horse, uniform clothing<br />
and other accoutrements, shall hold the same exempted<br />
from taxes, and all civil prosecutions during his continuance<br />
in said corps : Provided nevertheless. That when<br />
any officer or private of any troop of horse shall keep and<br />
use a stud horse in said troop, no mure than the tax of an<br />
ordinary horse on the list shall be exempted : Provided<br />
that all such horses and accoutrements shall be registered<br />
with the purser of the troop or company, which officer<br />
shall be recommended by the troop, and commissioned<br />
by the Governor. It shall be the duty of the purser to act<br />
as clerk, to keep a list of all delinquencies, to receive all<br />
lines and appropriate them agreeable to such rules as<br />
shall have been adopted by the said troop : it shall moreover<br />
be the duty of the purser to keep a list of the distribution<br />
of all public arms, ammunition, accoutrements<br />
military, take a receipt for the same, and make a report<br />
to his captain or commanding officer, every two months<br />
of all delinquencies and of all monies received, paid out<br />
and remaining in his hands. Also all public stores and<br />
equippage belonging to the company, and receive for his<br />
services such compensation as may be allowed by the said<br />
company. The commanding officers of troops, companies<br />
and light corps shall make a full report of the state there-<br />
of, every six months to the commander in chief.<br />
36. lie it further enacted, Tnat, in all cases not specially<br />
provided for in this act, the severai acts of congress<br />
providing for the national defence by establishing an uniform<br />
militia throughout the United States, hihali be observed<br />
by the militia of this Territory.<br />
37. Be it further enuc.cd, That, whenever in any of the<br />
several counties in this Territory the sheriff shall make<br />
report to any one or more judges or justices of the peace,<br />
that he hath in his custody one or more persons charged<br />
with any capital offence against the laws ol the United<br />
States or of this Territory, and that the jail of such county<br />
is in his opinion insufficient for the safe keeping of<br />
