the same term proceed to appoint one tit person, being a<br />
householder in each district or road division. And the<br />
clerk ot' the county court shall within twelve days after<br />
the appointment ot" the overseers as aforesaid of the sever-<br />
al districts, notify them of their appointment. And it<br />
shall moreover be the duty of the justice or justices of<br />
the peace laying- out the road divisions in his or their districts<br />
from time to time to apportion the persons there-<br />
in, subject to work on said roads, among the several districts<br />
in such manner and in such proportions as they<br />
should deem just and equitable, regarding as far as possible<br />
the convenience of the people and the situation of the<br />
roads, and to give to each overseer of roads in the district<br />
a copy of the appointment so made and a list of ihe names<br />
of those who are to work his road division.<br />
6. Be it further enacted, That, all able bodied free<br />
white males between the age of sixteen and forty five<br />
years, and residents for ninety days within any county in<br />
this Territory, and all able bodied male slaves of the same<br />
age and residence, shall be subject to work on the public<br />
roads and highways in such county.<br />
7. Be it further enacted, That, it shall be the duty of<br />
the county court in each county at their first term after<br />
the passage of this act, to appoint the justices of the<br />
peace and overseers of roads to perform the duties as is<br />
required by this act.<br />
8. Re it further enacted, That, all justices of the peace<br />
and overseers of roads so appointed shall serve for one<br />
year, and until others shall be appointed, and every overseer<br />
so appointed who shall refuse or neglect to do their<br />
duty as is directed by this act, or shall not keep the roads<br />
and bridges over small water courses, and causeways<br />
in swamps and lowlands in repair or let them remain uncleared<br />
or out of repair for and during the space of fifteen<br />
days uniess hindered by extremely bad weather, such overseer<br />
shall forfeit for every such offence the sum of ten<br />
dollars, to be recovered by indictment or presentment<br />
before any court proper to try the same, one half for the<br />
use of any person or persons prosecuting for the same,<br />
and the other half for the use of the county. And shall<br />
nevertheless be subject to an action for damages at the<br />
suit of any person injured by such refusal or neglect.<br />
And it shall be the duty of the grand jury of the county<br />
from time to time to make presentments or prefer indictments<br />
to the several courts of all such roads as they<br />
shall find out of repair.<br />
9. Be it further enacted* That, whenever the said roiuls.<br />
