A' j.istois— and all of said arms and accoutrements shall<br />
be exempt from executions or distresses, tor debt, damages<br />
or caxes. The said militia men shall be exempted<br />
from arrest in going to and returning from parades, inspections,<br />
and courts martial or rendezvous by order of<br />
iheir superior ulticeror in compliance with the provisions<br />
of tiiis act, except in cases of treason, felony or breach of<br />
the peace—Provided that tlie court for the assessment of<br />
fines shall have power to excuse any person for not ap-<br />
pearing- equipped as the law directs, if it shall appear to<br />
the satisfaction of the court that said person does not<br />
own said accoutrements, and is not able to provide them<br />
at his own expense.<br />
5. Be itfurther enacted, That, any officer commissioned<br />
by virtue of this act-, before he enters on the duties of<br />
his office, shail take an oath to support the constitution<br />
of the United States and the following oath or affirmation,<br />
to wit: " I do solemnly swear (or affirm) that I will faith-<br />
fully execute the duties in the according<br />
to the best of my abilities," which oath or affirmation<br />
shall be endorsed on the back of the commission<br />
by the person administering the same.<br />
6. Be it further enacted, That, in all cases where the<br />
day has not been previously assigned and mentioned at<br />
the last preceding muster, which is hereby declared to<br />
be legal notice, for the troop, company, battalion, regiment<br />
or brigade, to assemble on parade for muster, review<br />
or inspection, it shall be the duty of the commanding<br />
officer of the corps so to be assembled, to cause the<br />
orders to that effect to be given to the captains of their<br />
respective companies at least ten days before the said parade,<br />
and it shall be the duty of the said captains to cause<br />
three days previous notice at least, to be given to each<br />
individual of the company, by an officer or non-commissioned<br />
officer, in writing, left at his usual place of abode :<br />
Provided however, that when the commander in chief,<br />
the brigadier general, the commanding officer of regiments<br />
and battalions, and detached companies, for the<br />
purpose of repelling invasion or attack, or to aid and support<br />
the civil authority, shall command the service of the<br />
militia (which they are hereby authorised to do) such<br />
previous notice s i a 1 1 not be necessary, but every person<br />
subject to militia duty shall march at a moment's warn-<br />
ing.<br />
7. Be itfurther enacted^ That, it shall be the duty of the<br />
brigadier general and colonels to designate and assign the<br />
boundaries and limits of the regiments, and of the colonels,<br />
to designate the boundaries of the several battalions;<br />
