collector of the Territorial taxes, and by him paid into<br />

the county treasury.<br />

4. Be it further enacted, That, the coroner shall administer<br />

an oata or affirmation to at least twelve of the<br />

jurors who shall appear; to the foreman first in the following<br />

manner, " j ou solemnly swear (or affirm) that you<br />

will diligently enquire, and tru. presentment make, how,<br />

in what manner, and by whom A. B. who here lies dead,<br />

came to nis dt-ath, ana you shall deliver to me, coroner<br />

for this county, a true inquest thereof, according- to such<br />

evidence as shah be laid before you, and according to<br />

your knowledge," The other jurors shall swear or affirm<br />

in the following form, t; such oath (or affirmation) as<br />

your foreman haih taken, you and each of you, shall well<br />

and truly observe and keep on your respective parts."<br />

5. Be it further enacted, That the jurors being sworn,<br />

the coroner shall give them a charge upon their oaths to<br />

declare upon the death of the person, whether he or she<br />

died of felony, or mischance, or accident, and if of felony<br />

who were principals and who were accessaries, with what<br />

instiument he or she was struck or wounded, and so of<br />

all prevailing circun stances, which may come by presumption,<br />

and if by mischance or accident, whether by<br />

the act of man, and whether by hurt, fall, stroke, drowning<br />

or otherwise—also to enquire of the person (if anv<br />

wno were present, the finder of the body, his or her relations<br />

and neighbours, whether he or she was killea in<br />

the same place, where the body was found, and if elsewhere<br />

by whom and how the body was brought thence.<br />

And if he or she died of his or her own act, then to enquire<br />

of the manner, means, or instrument, and of all circumstances<br />

concerning it.<br />

6. Be it further enacted, That the jury being charged,<br />

shall remain together and proclamation shall be made,<br />

f(.r any person who can give evidence to draw near aud<br />

they shall be heard.<br />

7. Be 't further enacted, That, .every coroner shall be<br />

empowered to issue his warrant for witnesses, commanding<br />

them to come before him to be examined and declare<br />

their knowledge concerning the-matter in question, uc<br />

shall administer to them an oath or affirmation in the<br />

form following; "you do swear (or affirm) that the evidence<br />

you shall give to this inquest concerning the death<br />

of A. B. here lying dead s!>all be the truth, the whole<br />

truth and nothing but the truth."<br />

8. Be it further enacted, That, the testimony of such<br />

witnesses shall be taken down in writing aud subscribed by<br />

,»hem, and if it relate to the trial of any person concerned<br />
