less than thirty nor more than eighty privates—Provided,<br />

that when any number of militia in a county is not sufficient<br />

for a regiment, they shall compose a separate bat<br />

talion, or be formed into indepeudant companies, as the<br />

one or the other may be found the most convenient and<br />

proper—The regiments and battalions shall be numbered<br />

by the commander in chief from one upwards and both<br />

shall rank according to their numerical designation.<br />

The officers of equal grade shall rank according to their<br />

commissions and when there happens to be two such<br />

commissions of equal date the rank shall be determined<br />

by the field officers of the regiment by lot— provided, that<br />

at any regimental or battalion muster the several companies<br />

shall form a battalion or regiment according to<br />

their seniority, and the same rule shall apply when different<br />

corps are assembled together, excepting so far as by<br />

custom, usage or necessity the cavalry, artillery or light<br />

corps may be detached from the battalion.<br />

3. Be it further enacted, That, the Governor may authorize<br />

the field officers of any regiment immediately al-<br />

ter their appointment to recommend to him, who shall<br />

commission the same if approved, one captain, one first<br />

and one second lieutenant for each company in their regiment,<br />

and said recommendation shall authorize the persons<br />

so recommended to act till said commission or disapproval<br />

be made by the Governor, but if it be not made<br />

by the first of June, in the year one thousand eight hundred<br />

and twenty three, the authority of the said officers<br />

shall then cease, or he may at his election appoint said<br />

officers without such recommendation—The Governor<br />

shall appoint and commission to each regiment one<br />

colonel, one lieutenant colonel and one major—and all<br />

officers who shall accept an appointment under this law<br />

and shall continue to reside within their respective bounds<br />

shall bold their commissions during the pleasure of the<br />

Governor. The regimental staff shall consist of one<br />

adjutant, one quarter master, one paymaster, one surgeon<br />

and one surgeon's mate, one sergeant major and quarter<br />

master sergeant one drum major and one fife major to be<br />

appointed by the commandant of the regiment, and moreover<br />

the adjutant, quarter master, paymaster and surgeon.<br />

All sergeants and corporals of companies shall be appointed<br />

by the commandants of companies.<br />

4. Be itfurther enacted. That, each militia man shall<br />

attend the several musters, provided with a good musket.<br />

or rifle, powder horn and powder, balls and flints—And<br />

the commissioned officers of infantry, when on duty for<br />

parade, exercise, inspection or service, shall wear the uniform<br />

of the United States and be severally armed with a<br />

sword or hanger, and every officer whose duty require*
