APPENDIX A: SAMPLE CONTRACT<br />

8.7 Child/Elder Abuse/Fraud Reporting<br />

Contractor staff working on this Contract shall comply with<br />

California Penal Code (hereinafter "PC") Section 11164 et seq. <strong>and</strong><br />

shall report all known <strong>and</strong> suspected instances of child abuse to an<br />

appropriate child protective agency, as m<strong>and</strong>ated by these code<br />

sections. Child abuse reports shall be made by telephone to the<br />

Department of Children <strong>and</strong> Family <strong>Services</strong> hotline at (800) 540-<br />

4000 within 24 hours <strong>and</strong> shall submit all required information, in<br />

accordance with the PC Sections 11166 <strong>and</strong> 11167.<br />

Contractor staff working on this Contract shall comply with W&I<br />

Code section 15600 et seq. <strong>and</strong> shall report all known or suspected<br />

instances of physical abuse of elders <strong>and</strong> dependent adults either to<br />

an appropriate County adult protective services agency or to a local<br />

law enforcement agency, as m<strong>and</strong>ated by these code sections.<br />

The Contractor staff working on this Contract shall make the report<br />

on such abuse, <strong>and</strong> shall submit all required information, in<br />

accordance with the WIC Sections 15630, 15633 <strong>and</strong> 15633.5.<br />

Contractor staff working on this Contract shall also immediately<br />

report all suspected or actual welfare fraud situations to the County.<br />

8.8 Collective Bargaining Contract<br />

To comply with California Department of Social <strong>Services</strong><br />

Regulations (CDSS), Operations Manual Section 23-610 (c) (22),<br />

the Contractor agrees to provide to the County, upon request, a<br />

copy of any collective bargaining Contract covering employees<br />

providing services under the Contract.<br />

8.9 Complaints<br />

The Contractor shall develop, maintain <strong>and</strong> operate procedures for<br />

receiving, investigating <strong>and</strong> responding to complaints.<br />

8.9.1 Within 15 days business days after Contract effective date,<br />

the Contractor shall provide the County with the Contractor’s<br />

policy for receiving, investigating, <strong>and</strong> responding to user<br />

complaints.<br />

8.9.2 The County will review the Contractor’s policy <strong>and</strong> provide<br />

the Contractor with approval of said plan or with requested<br />

changes.<br />

8.9.3 If the County requests changes in the Contractor’s policy,<br />

the Contractor shall make such changes <strong>and</strong> resubmit the<br />

plan within five business days for County approval.<br />
