Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
§ 5.07 Performance Standards<br />
(a) Applicability. All uses in any district <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> shall conform in operation,<br />
location and construction to the subjective performance standards herein specified so that the public<br />
health, safety and welfare will be protected.<br />
(b) General. The location, size, design and operating characteristics <strong>of</strong> all uses shall minimize<br />
adverse effects, including visual impacts, on surrounding properties; and<br />
(c)<br />
Unreasonable Noise<br />
(1) It is unlawful to any person to make, continue, or cause or permit to be made or<br />
continued any unreasonable noise upon any premises within the <strong>Town</strong> <strong>of</strong><br />
<strong>Norwood</strong> under such person’s control or operation.<br />
(2) For purposes <strong>of</strong> this section “unreasonable noise” means any sound <strong>of</strong> such level<br />
or duration as to be or tend to be injurious to human health or welfare, or which<br />
would interfere with the enjoyment <strong>of</strong> life or property throughout the <strong>Town</strong> or any<br />
part there<strong>of</strong>.<br />
(3) The following noises shall be prima facie a violation <strong>of</strong> this section:<br />
a. <strong>Use</strong> <strong>of</strong> loudspeakers, amplifiers or other devices for amplification<br />
<strong>of</strong> sound which is plainly audible a distance <strong>of</strong> fifty feet from the<br />
building, structure or vehicle from which it is emanating between<br />
the hours <strong>of</strong><br />
i. For Sunday through Thursday: 9:00 p.m. and 7:00 a.m. the<br />
following morning.<br />
ii. For Friday and Saturday: 11:00 p.m. and 7:00 a.m. the<br />
following morning.<br />
b. Noise resulting from construction related activities during the time<br />
<strong>of</strong> 7:00 p.m. and 7:00 a.m. the following morning.<br />
(4) The following are factors which may be considered in determining whether a<br />
noise is in violation <strong>of</strong> this section:<br />
a. The volume <strong>of</strong> the noise.<br />
b. The intensity <strong>of</strong> the noise.<br />
c. The duration <strong>of</strong> the noise.<br />
d. Time <strong>of</strong> day or night <strong>of</strong> the noise.<br />
e. The volume and intensity <strong>of</strong> the background noise, if any.<br />
f. The proximity <strong>of</strong> the noise to residential development.<br />
g. The zoning, density, and types <strong>of</strong> development <strong>of</strong> the areas from<br />
which the noise emanates and to which it travels.<br />
h. Whether the noise is recurrent, intermittent or constant.<br />
