Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 6.05B Condominium Subdivision and Conversion<br />

(a) Purpose. The purpose <strong>of</strong> this section is to provide review procedures to ensure that the<br />

creation or conversion <strong>of</strong> condominium subdivisions will comply with the provisions <strong>of</strong> the<br />

<strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong>.<br />

(b) Definition. For purposes <strong>of</strong> this section a condominium is defined as a common interest<br />

community in which portions <strong>of</strong> the real estate are designated for separate ownership and the<br />

remainder <strong>of</strong> which is designated for common ownership solely by owners <strong>of</strong> the separate<br />

ownership portions.<br />

(c) Procedures. The procedures and standards for review and approval <strong>of</strong> a condominium<br />

subdivision shall be the same as that specified for all subdivisions, with applications meeting the<br />

definition <strong>of</strong> a small scale subdivision being processed pursuant to section 6.05A. However, all<br />

condominium conversions shall be reviewed as small scale subdivisions without regard to the<br />

number <strong>of</strong> units or size <strong>of</strong> the parcel proposed for conversion.<br />

(d) Compliance. Condominium subdivisions shall comply with all standards and review<br />

criteria generally applicable to subdivisions, as well as, to the extent applicable, the following:<br />

(1) Provisions <strong>of</strong> the Condominium Ownership Act, Section 38-33-101, et seq. C.R.S.<br />

(2) Provisions <strong>of</strong> the <strong>Colorado</strong> Common Interest Ownership Act. Section 38-33.5-<br />

101, et seq.<br />

(3) Title 38, Articles 50 and 51, C.R.S.<br />

(4) <strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> Section 1.00, General Provisions<br />

(5) <strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> Section 3.00, Zoning Regulations<br />

(6) <strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> Section 4.00, Subdivision Standards<br />

(7) <strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> Section 5.00, Site Development Standards.<br />

(8) <strong>Norwood</strong> <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> Sections 6.04, 6.05, 6.05A, 6.06, 6.07 and 6.08,<br />

Subdivision Procedures<br />

(e) Preliminary Plat Submission Requirements. In addition to the preliminary plat<br />

submission requirements contained in Section 6.04(b) or 6.05A (b), as applicable, the applicant<br />

shall submit:<br />

(1) Fifteen (15) copies <strong>of</strong> a preliminary condominium plat/map meeting the<br />
