CHAPTER 7<br />

LAND USE CODE<br />

§ 1.01 Enactment and Repeals<br />

§ 1.00 GENERAL PROVISIONS<br />

(a) Upon the adoption <strong>of</strong> this Chapter, the following are hereby repealed in their entirety: Title<br />

7: Zoning Regulations <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>, <strong>Colorado</strong>, passed and approved with Ordinance<br />

483, Series 1974 on Nov. 6, 1974, together with all amendments thereto; Ordinance #239, Series<br />

1974, creating the Planning and Zoning Commission, passed and approved in 1983, together with all<br />

amendments thereto; <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> Annexation Policies and Requirements Fourth Draft, passed<br />

and approved in March, 1983, together with all amendments thereto; and Subdivision Regulations<br />

for the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>, <strong>Colorado</strong>, passed and approved in October, 1985, together with all<br />

amendments thereto, <strong>of</strong> the <strong>Town</strong> <strong>Code</strong> <strong>of</strong> <strong>Norwood</strong> <strong>Colorado</strong>, 1993; and any other ordinance or<br />

regulation inconsistent with this <strong>Code</strong>.<br />

(b) The following is hereby adopted as Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> <strong>of</strong> the <strong>Town</strong> <strong>Code</strong> <strong>of</strong><br />

<strong>Norwood</strong>, <strong>Colorado</strong>. It may be referred to herein as "this chapter" or the "<strong>Land</strong> <strong>Use</strong> <strong>Code</strong>."<br />

(c) By the adoption <strong>of</strong> this chapter, no presently illegal use shall be deemed to have been<br />

legalized unless specifically such use falls within a zoning district where the actual use is a<br />

conforming use. Otherwise, such uses shall remain nonconforming uses where recognized, or an<br />

illegal use, as the case may be. It is further the intent and declared purpose <strong>of</strong> this chapter that no<br />

<strong>of</strong>fense committed, and no liability, penalty or forfeiture, either civil or criminal, incurred prior to the<br />

time the existing Zoning Regulations were repealed and this Zoning Ordinance adopted, shall be<br />

discharged or affected by such repeal; but prosecutions and suits for such <strong>of</strong>fenses, liability, penalties<br />

or forfeitures may be instituted or causes presently pending proceeded with in all respects as if such<br />

prior Ordinance had not been repealed.<br />

§ 1.02 Purpose<br />

The regulations <strong>of</strong> this chapter have been established in accordance with a Comprehensive Plan for<br />

the purpose <strong>of</strong> promoting the health, safety and general welfare <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>. They have<br />

been designed to lessen the congestion in the streets, to secure safety from fire, panic and other<br />

dangers, to provide adequate light and air, to prevent the overcrowding <strong>of</strong> land, to avoid undue<br />

concentration <strong>of</strong> population, to promote energy conservation and to facilitate the adequate provision<br />

<strong>of</strong> transportation, water, sewerage, schools, parks and other public requirements. They have been<br />

made with reasonable consideration, among other things, for the character <strong>of</strong> the districts, and their<br />

peculiar suitability for the particular uses specified; and with a view <strong>of</strong> conserving the value <strong>of</strong><br />

buildings and encouraging the most appropriate use <strong>of</strong> land throughout the <strong>Town</strong> consistent with a<br />

Comprehensive Plan.<br />
