Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 6.10 Conditional <strong>Use</strong> Permits<br />

(a) General. A conditional use is a use that may or may not be appropriate in a given location<br />

depending upon the specific characteristics <strong>of</strong> the proposed use and\or the conditions imposed upon<br />

the approval <strong>of</strong> the use. Conditional use permits may be approved for the uses indicated in the use<br />

regulations <strong>of</strong> the zoning district <strong>of</strong> the property for which the conditional use permit is requested.<br />

(b) Pre-application conference. Prior to the filing <strong>of</strong> a conditional use permit application, the<br />

applicant shall meet with the <strong>Town</strong> Planner or his or her designated agent to acquaint himself or<br />

herself with the requirements <strong>of</strong> the <strong>Town</strong>. As such meeting, the application contents, referral<br />

agencies, review procedures, use and area standards, and the general character <strong>of</strong> the development<br />

may be discussed. At the pre-application conference, the applicant may be represented by a land<br />

planner, engineer or surveyor.<br />

(c) Submittal requirements. The applicant shall file ten (10) copies <strong>of</strong> an application<br />

requesting a conditional use permit and <strong>of</strong> a title certificate from a licensed title company or<br />

attorney listing the name <strong>of</strong> the property owner(s) and all liens, easements and judgements <strong>of</strong> record<br />

affecting the subject property. The application shall include signature <strong>of</strong> property owner. If the<br />

applicant is not the owner <strong>of</strong> the property, s/he shall also submit a letter from the property owner<br />

designating the applicant as his/her agent with the authority to represent the application. The<br />

application shall be accompanied by or show the following information:<br />

(1) The street address and legal description <strong>of</strong> the property affected; and<br />

(2) Site plan and description <strong>of</strong> proposed use and any and all plans, information,<br />

operating data and expert evaluation necessary to clearly explain the location, function<br />

and characteristics <strong>of</strong> any building or use proposed; and<br />

(3) A report addressing the following standards:<br />

a. Compatibility with surrounding land uses<br />

b. Extent <strong>of</strong> noise, light, odor and activity and/or<br />

measures to mitigate intensity <strong>of</strong> use<br />

c. Circulation, traffic impact and parking<br />

d. Number <strong>of</strong> customers/other (if applicable)<br />

e. Ability to provide necessary utilities<br />

f. Provisions for providing services and maintaining the site<br />

g. Provisions for screening, lights and other items potentially causing <strong>of</strong>f-site<br />

impacts<br />

(4) A filing fee to cover the cost <strong>of</strong> review in accordance with the fee schedule<br />

adopted by resolution <strong>of</strong> the board <strong>of</strong> trustees.<br />

(d) Review by Planning and Zoning Commission. Before taking action on any proposed<br />

conditional use, the Board <strong>of</strong> Trustees shall submit the same to the Planning and Zoning<br />

Commission for its recommendation and report.<br />
