Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 3.13 PUD, Planned Unit Development Overlay District<br />

(a) Purpose and intent. The Planned Unit Development Overlay District is a rezoning<br />

process that, upon approval results in a detailed plan that is the basis for development <strong>of</strong> a<br />

particular property. An application for a PUD plan approval may be made for land located in any<br />

zoning district. The PUD Planned Unit Development Overlay District is designed primarily to<br />

provide flexibility to accommodate mixed-use, nontraditional and innovative developments and<br />

to encourage more efficient utilization <strong>of</strong> sites and the preservation <strong>of</strong> usable open space. The<br />

PUD shall be consistent with the requirements <strong>of</strong> the zone district in which the parcel is located<br />

unless a variation or variations <strong>of</strong> the dimensional limitations have been granted pursuant to this<br />

section. In addition to the use and area regulations <strong>of</strong> this section, development in the PUD<br />

Planned Unit Development Overlay District shall comply with all other provisions <strong>of</strong> this <strong>Land</strong><br />

<strong>Use</strong> <strong>Code</strong>.<br />

(b) Types <strong>of</strong> planned unit developments. The Board <strong>of</strong> Trustees <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>,<br />

<strong>Colorado</strong>, after public hearing and proper notice and after recommendation from the Planning<br />

and Zoning Commission, may authorize the creation <strong>of</strong> the Planned Unit Development Overlay<br />

Districts on parcels <strong>of</strong> land containing more than 20,000 square feet. A Planned Unit<br />

Development Overlay designation may be applied to land intended for residential, commercial or<br />

other development purposes.<br />

(c) Site plan requirement. In establishing a Planned Unit Development Overlay District in<br />

accordance with this section, the Planning and Zoning Commission shall require a<br />

comprehensive site plan <strong>of</strong> the development. Such site plan shall be approved as part <strong>of</strong> the<br />

resolution approving a Planned Unit Development Overlay and recorded as a burden to run with<br />

the land. Such required plan and resolution shall set forth the requirements for ingress and egress<br />

to the property, public streets or drives, with adequate right-<strong>of</strong>-way, sidewalks, utilities, drainage,<br />

parking space, height <strong>of</strong> building, maximum lot coverage, yards and open spaces, screening walls<br />

or fences, landscaping and other development and protective requirements including maintenance<br />

considered necessary to create a reasonable transition to and protection <strong>of</strong> the adjacent property.<br />

(d) Procedures for approval and conditions. Every Planned Unit Development Overlay<br />

District approved under the provisions <strong>of</strong> this chapter shall follow the procedure <strong>of</strong> Sec. 6.02 for<br />

and be considered an amendment to the zoning map. In approving the Planned Unit<br />

Development Overlay District , the Board <strong>of</strong> Trustees may impose conditions relative to the<br />

standard <strong>of</strong> development and such conditions shall be complied with before a Zoning<br />

Development Permit is issued for the use <strong>of</strong> the land or any structure that is part <strong>of</strong> the Planned<br />

Unit Development Overlay District and such conditions shall not be construed as conditions<br />

precedent to the approval <strong>of</strong> the zoning amendment, but shall be construed as conditions<br />

precedent to the granting <strong>of</strong> a Zoning Development Permit. All Planned Unit Development<br />

Overlay Districts approved in accordance with the provisions <strong>of</strong> this chapter shall be referenced<br />

on the Official Zoning Map and a list <strong>of</strong> such Planned Unit Development Overlay Districts,<br />

together with the category <strong>of</strong> uses permitted therein, shall be maintained in the <strong>of</strong>fice <strong>of</strong> the<br />

<strong>Town</strong> Clerk.<br />
