Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

(3) Requirements for approval. Such amendments shall not become effective except by<br />

resolution <strong>of</strong> the Commission carried by the favorable vote <strong>of</strong> a two-thirds <strong>of</strong> the entire<br />

membership <strong>of</strong> the Commission. The resolution shall refer expressly to the maps and<br />

descriptive matter intended by the commission to form the whole or part <strong>of</strong> the plan, and the<br />

action taken shall be recorded on the map and plan and descriptive matter by the identifying<br />

signature <strong>of</strong> the chairperson or secretary <strong>of</strong> the Commission. An attesting copy <strong>of</strong> the plan<br />

or part there<strong>of</strong> shall be certified to each governmental body <strong>of</strong> the territory affected and,<br />

after the approval by each body, shall be filed with the county clerk and recorder <strong>of</strong> <strong>San</strong><br />

<strong>Miguel</strong> <strong>County</strong>.<br />

(4) Board notification <strong>of</strong> disapproval. In the event <strong>of</strong> a disapproval by the Commission<br />

<strong>of</strong> a proposed master plan or an amendment to the plan, the commission shall communicate<br />

its reasons to the Board <strong>of</strong> Trustees.<br />

(5) Statutory approval requirement. Failure <strong>of</strong> the Commission to act within sixty days<br />

from and after the date <strong>of</strong> <strong>of</strong>ficial submission to it shall be deemed approval.<br />

(d) Action by Board <strong>of</strong> Trustees. A public hearing shall be held by the governing body before<br />

adopting any proposed amendment, supplement or change.<br />

(1) Notification requirements for master plan amendment. The <strong>Town</strong> Clerk shall cause<br />

notice <strong>of</strong> the public hearing to be given by one publication in a newspaper <strong>of</strong> general<br />

circulation in the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> without the necessity <strong>of</strong> notifying property owners by<br />

mail. Notice shall be mailed to all owners <strong>of</strong> mineral estates <strong>of</strong> record in the records <strong>of</strong><br />

the <strong>San</strong> <strong>Miguel</strong> county clerk and recorder. Such notice shall state the time and place <strong>of</strong><br />

such hearing and the nature <strong>of</strong> the amendment to be considered, which time shall not be<br />

earlier than fifteen (15) days from the date <strong>of</strong> publication.<br />

(2) Positive Commission recommendation. If the Commission has recommended<br />

approval, such plan or amendment shall not become effective except by the favorable vote<br />

<strong>of</strong> a majority <strong>of</strong> the quorum <strong>of</strong> the Board <strong>of</strong> Trustees present and voting.<br />

(3) Negative Commission recommendation. If the Commission has recommended<br />

denial, such plan or amendment shall not become effective unless the Board <strong>of</strong> Trustees<br />

overrules such disapproval by a recorded vote <strong>of</strong> not less than two-thirds <strong>of</strong> its entire<br />

membership.<br />

(e) Standards for approval. The Planning and Zoning Commission and Board <strong>of</strong><br />

Trustees shall evaluate the request and consider changes in circumstances since the adoption <strong>of</strong><br />

the Master Plan.<br />
