Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

Comprehensive Plan: The comprehensive plan <strong>of</strong> the <strong>Town</strong> and adjoining areas adopted by the<br />

Planning and Zoning Commission and Board <strong>of</strong> Trustees, including all <strong>of</strong> its revisions. The plan<br />

indicates the general locations recommended for various land uses, transportation routes, public and<br />

private buildings, streets, parks and other public and private developments and improvements.<br />

Condominium, Attached: A residential dwelling unit in a structure containing two or more such<br />

units, the living spaces <strong>of</strong> which are individually owned; the balance <strong>of</strong> the property (both land and<br />

building) is owned either in common by the owners <strong>of</strong> the individual units or by an association<br />

consisting <strong>of</strong> such owners.<br />

Condominium, Detached: One <strong>of</strong> at least two individually owned, unconnected residential<br />

dwelling units located on property owned either in common by the owners <strong>of</strong> such units or by an<br />

association consisting <strong>of</strong> such owners.<br />

Constructive Notice: Notice that shall be deemed given as a result <strong>of</strong> actual notice or any action by<br />

the <strong>Town</strong> recorded in the public record maintained by the <strong>County</strong> Clerk.<br />

Contiguous: Sharing a common border at more than a single point <strong>of</strong> intersection and in such a<br />

manner that the shared boundaries are touching and not separated except by boundaries <strong>of</strong> public or<br />

private rights-<strong>of</strong>-way, watercourses or water bodies, or other minor geographical divisions <strong>of</strong> similar<br />

nature running parallel and between the shared boundaries. Contiguity is not the mere touching <strong>of</strong><br />

points at intersections.<br />

Convenience Store: A retail establishment primarily <strong>of</strong>fering for sale meats, fruits, vegetables,<br />

bakery products, dairy products, personal care items, cleaning products and similar household items<br />

to a localized or neighborhood market, for <strong>of</strong>f-premise consumption.<br />

Cottage Dwelling Units: A detached dwelling unit not greater than 850 square feet in lot<br />

coverage and a maximum floor area <strong>of</strong> 1500 square feet or 1.5 times the lot coverage, whichever is<br />

less, constructed as part <strong>of</strong> a comprehensive site plan in a single application for development.<br />

Cottage Housing Development: A comprehensive development consisting <strong>of</strong> cottages on a<br />

single lot. The site plan includes individual dwelling units clustered around a shared court yard, <strong>of</strong>f<br />

street parking and access. The cluster includes a minimum <strong>of</strong> four and maximum <strong>of</strong> nine units<br />

included in a single application. Cottage housing development will be accomplished through a<br />

condominium subdivision and include covenants.<br />

Cul-de-sac: A street that terminates at one (1) end in a vehicular turnaround.<br />

Custom Personal Service: Barber shop, beauty shop, tailor, dressmaker, shoe shop or similar shop<br />

<strong>of</strong>fering custom service.<br />

Day Camp for Children: A facility arranged and conducted for the organized recreation and<br />

instruction <strong>of</strong> children, including outdoor activities, on a daytime basis only.<br />
