Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 6.13 Board <strong>of</strong> Adjustments<br />

(a) Creation and organization. There is hereby created a board known as the Board <strong>of</strong><br />

Adjustment, which shall be organized as follows.<br />

(1) The Board <strong>of</strong> Adjustment shall consist <strong>of</strong> five (5) regular members, including one<br />

member <strong>of</strong> the Planning and Zoning Commission or Board <strong>of</strong> Trustees, appointed by the<br />

Mayor, subject to ratification by a majority <strong>of</strong> the Board <strong>of</strong> Trustees.<br />

(2) In addition to the five (5) regular members <strong>of</strong> the Board <strong>of</strong> Adjustment, two (2)<br />

alternate members <strong>of</strong> the Board <strong>of</strong> Adjustment, who shall serve in the absence <strong>of</strong> one (1) or<br />

more regular members when requested to do so by the Chairperson <strong>of</strong> the Board or Mayor,<br />

may be appointed by the Mayor, subject to ratification by majority <strong>of</strong> the Board <strong>of</strong> Trustees,<br />

so that all cases heard by the Board <strong>of</strong> Adjustment will always be heard by a minimum <strong>of</strong><br />

four (4) members.<br />

(3) Each member <strong>of</strong> the Board shall be a resident citizen and qualified voter <strong>of</strong> the<br />

<strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>, <strong>Colorado</strong>, at the time <strong>of</strong> his or her appointment. A member that ceases<br />

to reside in the <strong>Town</strong> during his or her term <strong>of</strong> <strong>of</strong>fice shall immediately forfeit their <strong>of</strong>fice.<br />

(4) The term <strong>of</strong> <strong>of</strong>fice <strong>of</strong> members <strong>of</strong> the Board shall be for two (2) years. Two (2)<br />

members shall be appointed for two (2) year terms beginning September 30, in even years<br />

and three (3) members shall be appointed for two (2) year terms beginning September 30, in<br />

odd years. Alternates shall serve the same term <strong>of</strong> <strong>of</strong>fice as regular members; one (1)<br />

member shall be appointed beginning September 30, in even years and one (1) member<br />

beginning September 30, in odd years. Regular and alternate members may be removed<br />

before their term <strong>of</strong> <strong>of</strong>fice expires.<br />

(5) Board members shall serve without compensation.<br />

(b)<br />

Officers and procedures.<br />

(1) The Mayor shall designate, and the Board <strong>of</strong> Trustees confirm, a chairperson as well<br />

as a vice-chairperson from the regular members <strong>of</strong> the Board each year. The designation<br />

and confirmation shall be made no less than fifteen (15) days before the terms <strong>of</strong> the current<br />

members expire.<br />

(2) The chairperson shall preside over meetings. In the event a question over<br />

procedures arise, Robert’s Rules <strong>of</strong> Order shall apply.<br />

(3) The vice-chairperson shall assist the chairperson in directing the affairs <strong>of</strong> the Board<br />

<strong>of</strong> Adjustment. In the absence <strong>of</strong> the chairperson the vice-chairperson shall assume the<br />

duties <strong>of</strong> the chairperson.<br />

(4) The recording <strong>of</strong> the minutes <strong>of</strong> the Board <strong>of</strong> Adjustment meetings shall be the<br />
