Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

subdivision to the <strong>Town</strong> Planner, the <strong>Town</strong> Planner shall submit the construction plans to<br />

the <strong>Town</strong> Engineer/Consultant for review. The <strong>Town</strong> Engineer/Consultant shall review the<br />

plans and submit to the Planning and Zoning Commission his or her report at the final plat<br />

presentation. The developer shall pay the reasonable cost <strong>of</strong> review <strong>of</strong> the construction<br />

plans before the final plat is presented to the Board <strong>of</strong> Trustees.<br />

(c)<br />

Review by Commission.<br />

(1) Action by Commission. The final plat shall be presented to the Planning and<br />

Zoning Commission at its next regular meeting, along with any appropriate<br />

recommendation by the <strong>Town</strong> Planner. The Planning and Zoning Commission shall act on<br />

the final plat within thirty (30) days after the <strong>of</strong>ficial filing date or within a reasonable time<br />

thereafter.<br />

(2) Review in stages. An owner or subdivider, at his or her option, may obtain approval<br />

<strong>of</strong> a portion or a section <strong>of</strong> a subdivision provided he or she meets all the requirements <strong>of</strong><br />

this chapter with reference to such portion or section in the same manner as is required for a<br />

complete subdivision. In the event a subdivision and the final plat there<strong>of</strong> is approved by<br />

the Planning and Zoning Commission in sections, each final plat <strong>of</strong> each section is to carry<br />

the name <strong>of</strong> the entire subdivision, but is to bear a distinguishing letter, number or subtitle.<br />

Block numbers shall run consecutively throughout the entire subdivision, even though such<br />

subdivision may be finally approved in sections.<br />

(3) Approval by Commission. After the Planning and Zoning Commission has<br />

determined that the plat is in proper form, that the arrangement <strong>of</strong> the development<br />

proposed for the property being subdivided is consistent with zoning regulations and that<br />

the subdivision complies with the provisions <strong>of</strong> this chapter, it shall act to approve the plat,<br />

subject to action by the Board <strong>of</strong> Trustees.<br />

(4) Disapproval by Commission. Final plats that are disapproved by the Planning and<br />

Zoning Commission shall be returned to the subdivider by the <strong>Town</strong> Planner with an<br />

attached statement <strong>of</strong> the reasons for such action.<br />

(5) Appeal. Any subdivider aggrieved by any finding or action <strong>of</strong> the Planning and<br />

Zoning Commission that involves the jurisdiction <strong>of</strong> the Board <strong>of</strong> Trustees as to dedication<br />

or improvements, shall have the right <strong>of</strong> appeal to the Board <strong>of</strong> Trustees within thirty (30)<br />

days from the date <strong>of</strong> such finding or action but any appeal must be taken within thirty (30)<br />

days <strong>of</strong> such action and not thereafter.<br />

(d) Review by Board <strong>of</strong> Trustees. The Board <strong>of</strong> Trustees shall consider all proposals with<br />

respect to the dedication <strong>of</strong> right-<strong>of</strong>-way for public use, the construction <strong>of</strong> utilities, streets,<br />

drainage, and other improvements, and when satisfied with the proposals, shall authorize the<br />

establishment <strong>of</strong> agreements for same and ratify the approval action <strong>of</strong> the Planning and Zoning<br />

Commission relative to the final plat.<br />
