Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
§ 6.06 Acceptance <strong>of</strong> Subdivision Improvements<br />
(a)<br />
Time frame for completion.<br />
(1) Plan resubmittal. If construction has not commenced within one (1) year after<br />
approval <strong>of</strong> the plans, resubmittal <strong>of</strong> plans may be required by the <strong>Town</strong> Engineer for<br />
meeting current standards and engineering requirements. These plans will be reviewed and<br />
comments noted in fifteen (15) working days. A fee as provided for in the fee schedule<br />
adopted by resolution <strong>of</strong> the <strong>Town</strong> Board is required upon the resubmittal <strong>of</strong> plans for<br />
review. “Construction” shall mean the start or commencement <strong>of</strong> construction <strong>of</strong> <strong>Town</strong><br />
maintained facilities.<br />
(2) Expiration and extension <strong>of</strong> approval. If the public improvements for a subdivision<br />
have not been constructed and accepted by the <strong>Town</strong>, and the corresponding final plat for<br />
said subdivision filed in the plat records <strong>of</strong> the <strong>San</strong> <strong>Miguel</strong> <strong>County</strong> within eighteen (18)<br />
months from the date <strong>of</strong> final plat approval by the <strong>Town</strong>, said final plat shall be null and<br />
void and shall conclusively be deemed to be withdrawn, without further action by the<br />
<strong>Town</strong>; provided however, this provision shall not apply to final plats approved by the <strong>Town</strong><br />
prior to the adoption <strong>of</strong> this <strong>Land</strong> <strong>Use</strong> <strong>Code</strong> (adoption date). If the public improvements for<br />
a subdivision that was approved prior to (adoption date) have not been constructed and<br />
accepted by the <strong>Town</strong>, and the corresponding final plat for said subdivision filed in the map<br />
and plat records <strong>of</strong> the <strong>San</strong> <strong>Miguel</strong> <strong>County</strong> by within 18 months <strong>of</strong> the adoption <strong>of</strong> the <strong>Land</strong><br />
<strong>Use</strong> <strong>Code</strong> (insert appropriate date) said final plat shall be null and void and shall<br />
conclusively be deemed to be withdrawn, without further action by the <strong>Town</strong>. An<br />
approved, unexpired final subdivision plat may be extended once for a period not to exceed<br />
twelve (12) months, pursuant to the following provisions:<br />
a. The Board <strong>of</strong> Trustees may extend the approval <strong>of</strong> the final plat, for good<br />
cause shown by the applicant, if there has been no significant change in<br />
development conditions affecting the subdivision plan and the plat continues to<br />
comply with all applicable standards and ordinances.<br />
b. A request for an extension <strong>of</strong> time to complete final public improvements<br />
for a subdivision pursuant to these provisions shall be submitted to the <strong>Town</strong><br />
Planner no later than the date the final subdivision plat expires. The request shall be<br />
in writing, and the application shall state the reason and justification for the<br />
requested extension.<br />
(b) Improvements required. The improvement <strong>of</strong> all streets, sidewalks, alleys, and<br />
drainageways as herein required shall be in accordance with the standard specifications <strong>of</strong> the <strong>Town</strong><br />
<strong>of</strong> <strong>Norwood</strong> for installation <strong>of</strong> such improvements. The <strong>Town</strong> shall withhold all improvements and<br />
services <strong>of</strong> whatsoever nature, from all additions that have not been approved in accordance with<br />
the regulations herein contained.<br />
(c)<br />
Inspection. All construction work, such as street grading, street paving, storm sewers, curb<br />
