Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

retained by the Planning and Zoning Commission. A notation <strong>of</strong> the action taken and<br />

requisite reasons therefor shall be entered in the records <strong>of</strong> the Planning and Zoning<br />

Commission.<br />

(6) Disapproval by Commission. Small scale subdivision plats that are disapproved by<br />

the Planning and Zoning Commission shall be returned to the subdivider by the <strong>Town</strong><br />

Planner with an attached statement <strong>of</strong> the reasons for such action.<br />

(7) Appeal. Any subdivider aggrieved by any finding or action <strong>of</strong> the Planning and<br />

Zoning Commission that involves the jurisdiction <strong>of</strong> the Board <strong>of</strong> Trustees as to dedication<br />

or improvements, shall have the right <strong>of</strong> appeal to the Board <strong>of</strong> Trustees within thirty (30)<br />

days from the date <strong>of</strong> such finding or action but any appeal must be taken within thirty (30)<br />

days <strong>of</strong> such action and not thereafter.<br />

(e) Review by Board <strong>of</strong> Trustees. The Board <strong>of</strong> Trustees shall consider all proposals with<br />

respect to the dedication <strong>of</strong> right-<strong>of</strong>-way for public use, the construction <strong>of</strong> utilities, streets,<br />

drainage, and other improvements, and when satisfied with the proposals, shall authorize the<br />

establishment <strong>of</strong> agreements for same and ratify the approval action <strong>of</strong> the Planning and Zoning<br />

Commission relative to the small scale subdivision plat.<br />

(f)<br />

Action following approval.<br />

(1) Certification <strong>of</strong> approval. The Planning and Zoning Commission’s approval and the<br />

Board <strong>of</strong> Trustees’s ratification <strong>of</strong> the final plat shall authorize the Chairman <strong>of</strong> the<br />

Planning and Zoning Commission to execute the certificate <strong>of</strong> approval on the original copy<br />

<strong>of</strong> the final plat.<br />

(2) Recordation <strong>of</strong> plats. The final plat for any subdivision located within the corporate<br />

limits <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> shall then be caused to be filed <strong>of</strong> record by the subdivider<br />

in the plat records <strong>of</strong> <strong>San</strong> <strong>Miguel</strong> <strong>County</strong>, but only after the Board <strong>of</strong> Trustees has <strong>of</strong>ficially<br />

acted upon the final plat with reference to improvements, dedications and utilities.<br />

Recording fees shall be paid by the developer.<br />

(3). Sign <strong>of</strong>f on construction plans, if any. Three sets <strong>of</strong> final construction plans<br />

shall be provided by the subdivider and signed by the subdivider and the Board <strong>of</strong><br />

Trustees or the Boards’ designee and retained as a record by the <strong>Town</strong> Clerk.<br />
