Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
§ 6.16 Special Exceptions<br />
The Planning and Zoning Commission shall have the power to hear and decide the following<br />
special exceptions to the terms <strong>of</strong> this chapter.<br />
Sec. 6.16 (a) Reconstruction <strong>of</strong> non-conforming use<br />
The Planning and Zoning Commission shall be authorized to permit the reconstruction <strong>of</strong> a<br />
building occupied by a nonconforming use, or permit resumption <strong>of</strong> a nonconforming use on<br />
the lot or tract occupied by such building, or the reconstruction <strong>of</strong> a structure destroyed by fire<br />
or the elements on the tract occupied by such building, provided an application is submitted to<br />
the town clerk within six months <strong>of</strong> the date the structure was destroyed. All new construction<br />
shall conform to the applicable uniform building code, current fire code and any other<br />
applicable safety and construction codes which are in effect at the time the rebuilding is<br />
proposed.<br />
(b) Discontinuance <strong>of</strong> nonconforming use. The Planning and Zoning Commission shall be<br />
authorized to require the discontinuance <strong>of</strong> nonconforming uses <strong>of</strong> land or structures under any plan<br />
whereby the full value <strong>of</strong> the structure and facilities can be amortized within a definite period <strong>of</strong><br />
time, taking into consideration the general character <strong>of</strong> the neighborhood and the necessity <strong>of</strong> all<br />
property to conform to the regulations <strong>of</strong> this chapter. All actions to discontinue a nonconforming<br />
use <strong>of</strong> land or structure shall be taken with due regard to the property rights <strong>of</strong> the persons affected<br />
when considered in the light <strong>of</strong> the public welfare and the character <strong>of</strong> the area surrounding the<br />
designated nonconforming use and the conservation and preservation <strong>of</strong> the property.<br />
(c) Status <strong>of</strong> nonconforming uses. The Planning and Zoning Commission shall, from time to<br />
time, on its own motion or upon cause presented by interested property owners or on request <strong>of</strong> the<br />
Board <strong>of</strong> Trustees or Planning and Zoning Commission inquire into the existence, continuation or<br />
maintenance <strong>of</strong> any nonconforming use within the <strong>Town</strong>.<br />
§ 6.17 Temporary <strong>Use</strong> Permits<br />
Temporary use permits shall be issued by the Planning and Zoning Commission, subject to the<br />
following provisions.<br />
(a) Zoning. The use for which the permit is requested shall be authorized as a temporary use in<br />
the district in which the use is to be located.<br />
(b) Conditions. The applicant shall meet all conditions for such temporary use permit set forth<br />
in this chapter.<br />
(c) Time limit. A time limit for the discontinuance <strong>of</strong> the temporary use shall be specified on<br />
the temporary use permit.<br />
