acre or more depending upon studies <strong>of</strong> the particular soil condition and evaluation <strong>of</strong> the<br />

physiographic and geologic character <strong>of</strong> the area being subdivided.<br />

(4) Action within 30 days. Following review <strong>of</strong> the preliminary plat and other materials<br />

submitted for conformity there<strong>of</strong> to these regulations, and negotiations with the subdivider<br />

on changes deemed advisable and the kind and extent <strong>of</strong> improvements to be made by the<br />

subdivider, the Planning and Zoning Commission shall, within thirty (30) days, act thereon<br />

as submitted or modified, and if approved the Planning and Zoning Commission shall<br />

express its approval as conditional approval and state the conditions <strong>of</strong> such approval, if<br />

any, or if disapproved, shall express its disapproval and its reasons therefor.<br />

(5) Notation <strong>of</strong> action. The action <strong>of</strong> the Planning and Zoning Commission shall be<br />

noted on two (2) copies <strong>of</strong> the preliminary plat, referenced and attached to any conditions<br />

determined. One (1) copy shall be returned to the subdivider and the other retained by the<br />

Planning and Zoning Commission. A notation <strong>of</strong> the action taken and requisite reasons<br />

therefor shall be entered in the records <strong>of</strong> the Planning and Zoning Commission.<br />

(f)<br />

Review by Board <strong>of</strong> Trustees.<br />

(1) Submittal to Board <strong>of</strong> Trustees. The <strong>Town</strong> Planner shall, at the next regularly<br />

scheduled Board <strong>of</strong> Trustees meeting following conditional approval or disapproval by the<br />

Planning and Zoning Commission, submit the preliminary plat with the conditions<br />

established by the Planning and Zoning Commission to the Board <strong>of</strong> Trustees for their<br />

consideration.<br />

(2) Action by Board <strong>of</strong> Trustees. The Board <strong>of</strong> Trustees shall approve or disapprove the<br />

preliminary plat as to street dedication and utility services either with or without special<br />

provisions.<br />

(g)<br />

Effect <strong>of</strong> preliminary plat approval.<br />

(1) Not approval <strong>of</strong> final plat. Conditional approval <strong>of</strong> a preliminary plat shall not<br />

constitute approval <strong>of</strong> the final plat. Rather, it shall be deemed an expression <strong>of</strong> approval to<br />

the layout submitted on the preliminary plat as a guide to the preparation <strong>of</strong> the final plat.<br />

(2) Lapse <strong>of</strong> approval. Preliminary approval <strong>of</strong> the subdivision shall be valid for a<br />

period <strong>of</strong> twelve (12) months from the date <strong>of</strong> approval and the general terms and<br />

conditions under which the preliminary approval was granted will not be changed. The<br />

Planning and Zoning Commission shall withdraw its preliminary approval <strong>of</strong> a subdivision<br />

unless the final plat is submitted within the twelve (12) month period or unless the twelve<br />

(12) month period is extended by the Planning and Zoning Commission at the request <strong>of</strong> the<br />

subdivider.<br />
