Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />

§ 6.03 Master Plan Amendments.<br />

(a) Initiation <strong>of</strong> Amendment. Any person having a proprietary interest in any property may<br />

petition the Board <strong>of</strong> Trustees for a change or amendment to the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> Comprehensive<br />

Plan ("Master Plan"), or the Planning and Zoning Commission may on its own motion or on request<br />

from the Board <strong>of</strong> Trustees, institute study and proposal for changes and amendments in the public<br />

interest.<br />

(b)<br />

Application for Master Plan Amendment.<br />

(1) Any person having a proprietary interest in any property within the corporate limits<br />

<strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong>, <strong>Colorado</strong>, requesting a change or amendment to the master plan<br />

affecting such property, shall file ten (10) copies <strong>of</strong> an application for such change or<br />

amendment with the <strong>Town</strong> Planner, which petition shall clearly state the requested change<br />

or amendments with the <strong>Town</strong> Planner. The application shall include signature <strong>of</strong> property<br />

owner. If the applicant is not the owner <strong>of</strong> the property, s/he shall also submit a letter<br />

from the property owner designating the applicant as his/her agent with the authority to<br />

represent the application.<br />

(2) The application shall clearly include:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Requested change in designation for property;<br />

Legal description <strong>of</strong> affected property;<br />

Rationale for change and supporting information to justify change.<br />

Map showing area included in request<br />

(3) A filing fee shall be submitted to cover the cost <strong>of</strong> review and processing with every<br />

private sector application in accordance with the fee schedule adopted by resolution <strong>of</strong> the<br />

Board <strong>of</strong> Trustees.<br />

(c) Review by Planning and Zoning Commission. Before taking action on any proposed<br />

amendment, supplement or change, the governing body shall submit the same to the Planning and<br />

Zoning Commission for its recommendation and report.<br />

(1) Public hearing required. Before adopting any plan, any part, amendment, extension<br />

or addition to the plan, the Planning and Zoning Commission shall hold a public hearing<br />

prior to making its recommendation to the Board <strong>of</strong> Trustees.<br />

(2) Notification requirements for master plan amendment. The <strong>Town</strong> Clerk shall cause<br />

notice <strong>of</strong> the public hearing to be given by one publication in a newspaper <strong>of</strong> general<br />

circulation in the <strong>Town</strong> <strong>of</strong> <strong>Norwood</strong> without the necessity <strong>of</strong> notifying property owners by<br />

mail. Such notice shall state the time and place <strong>of</strong> such hearing and the nature <strong>of</strong> the<br />

amendment to be considered, which time shall not be earlier than fifteen (15) from the date<br />

<strong>of</strong> publication. Notice shall also be mailed to all owners <strong>of</strong> mineral estates <strong>of</strong> record in the<br />

records <strong>of</strong> the <strong>San</strong> <strong>Miguel</strong> county clerk and recorder.<br />
