Chapter 7: <strong>Land</strong> <strong>Use</strong> <strong>Code</strong><br />
(e)<br />
Status <strong>of</strong> prior and future approvals.<br />
(1) In the Planned Unit Development Overlay Districts previously approved, where<br />
the Board <strong>of</strong> Trustees approved conditional minimum development requirements for<br />
single-family dwellings that are less stringent than the minimum development<br />
requirements contained in this chapter for single-family dwellings in Planned Unit<br />
Development Overlay Districts, the less stringent minimum development requirements<br />
set forth in such Planned Unit Development Overlay Districts are hereby ratified.<br />
(2) In all Planned Unit Development Overlay Districts previously approved that are<br />
silent or contain no conditional minimum development requirements for single-family<br />
dwellings, the minimum development requirements contained in this chapter for singlefamily<br />
dwellings in Planned Unit Development Overlay Districts shall apply.<br />
(f)<br />
Permitted, conditional and temporary uses. The land uses permitted shall be those <strong>of</strong><br />
the underlying zone district.<br />
(g) Maximum density. The maximum density shall be no greater than that permitted in the<br />
underlying zone district prior to PUD approval. Furthermore, densities may be reduced if:<br />
(1) There is not sufficient water pressure and other utilities to service the proposed<br />
development;<br />
(2) There are not adequate roads to ensure fire protection, snow removal and road<br />
maintenance to the proposed development;<br />
(3) The land is not suitable for the proposed development because <strong>of</strong> ground reasons<br />
<strong>of</strong> soil or geologic conditions;<br />
(4) The proposed development will have a deleterious effect on air quality in the<br />
surrounding area and the <strong>Town</strong>; or<br />
(5) The design and location <strong>of</strong> any proposed structure, road, or driveway in the<br />
proposed development is not compatible with surrounding land uses, would adversely<br />
affect the character <strong>of</strong> the <strong>Town</strong> or cause harmful disturbance to critical natural features<br />
<strong>of</strong> the site.<br />
(h) Minimum lot area per dwelling. The minimum lot area for non-residential uses shall be<br />
four thousand feet (4000') in the PUD, Planned Unit Development Overlay District shall be as<br />
follows, subject to Sec. 3.06(c):<br />
(1) Four thousand (4,000) square feet per single-family dwelling unit,<br />
(2) Three thousand (3,000) square feet per duplex dwelling unit,<br />
